REGULATION(EU)No305/2011OFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof9March2011layingdownharmonisedconditionsforthemarketingofconstructionproductsandrepealingCouncilDirective89/106/EEC(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle114thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),Actinginaccordancewiththeordinarylegislativeprocedure(2),Whereas:(1)TherulesofMemberStatesrequirethatconstructionworksbedesignedandexecutedsoasnottoendangerthesafetyofpersons,domesticanimalsorpropertynordamagetheenvironment.(2)Thoseruleshaveadirectinfluenceontherequirementsofconstructionproducts.Thoserequirementsareconsequentlyreflectedinnationalproductstandards,nationaltechnicalapprovalsandothernationaltechnicalspecificationsandprovisionsrelatedtoconstructionproducts.Duetotheirdisparity,thoserequirementshindertradewithintheUnion.(3)ThisRegulationshouldnotaffecttherightofMemberStatestospecifytherequirementstheydeemnecessarytoensuretheprotectionofhealth,theenvironmentandworkerswhenusingconstructionproducts.(4)MemberStateshaveintroducedprovisions,includingrequirements,relatingnotonlytosafetyofbuildingsandotherconstructionworksbutalsotohealth,durability,energyeconomy,protectionoftheenvironment,economicaspects,andotherimportantaspectsinthepublicinterest.Laws,regulations,administrativemeasuresorcase-law,establishedeitheratUnionorMemberStatelevel,concerningconstructionworksmayhaveanimpactontherequirementsofconstructionproducts.Sincetheireffectonthefunctioningoftheinternalmarketislikelytobeverysimilar,itisappropriatetoconsidersuchlaws,regulations,administrativemeasuresorcase-lawas‘provisions’forthepurposesofthisRegulation.(5)Whereapplicable,provisionsforanintendeduseorusesofaconstructionproductinaMemberState,aimedatfulfillingbasicrequirementsforconstructionworks,determinetheessentialcharacteristicstheperformanceofwhichshouldbedeclared.Inordertoavoidanemptydeclarationofperformance,atleastoneoftheessentialcharacteristicsofaconstructionproductwhicharerelevantforthedeclareduseorusesshouldbedeclared.(6)CouncilDirective89/106/EECof21December1988ontheapproximationoflaws,regulationsandadministrativeprovisionsoftheMemberStatesrelatingtoconstructionproducts(3)aimedtoremovetechnicalbarrierstotradeinthefieldofconstructionproductsinordertoenhancetheirfreemovementintheinternalmarket.(7)Inordertoachievethatobjective,Directive89/106/EECprovidedfortheestablishmentofharmonisedstandardsforconstructionproductsandprovidedforthegrantingofEuropeantechnicalapprovals.(8)Directive89/106/EECshouldbereplacedinordertosimplifyandclarifytheexistingframework,andimprovethetransparencyandtheeffectivenessoftheexistingmeasures.EN4.4.2011OfficialJournaloftheEuropeanUnionL88/5(1)OJC218,11.9.2009,p.15.(2)PositionoftheEuropeanParliamentof24April2009(OJC184E,8.7.2010,p.441),positionoftheCouncilatfirstreadingof13September2010(OJC282E,19.10.2010,p.1),positionoftheEuropeanParliamentof18January2011(notyetpublishedintheOfficialJournal)anddecisionoftheCouncilof28February2011.(3)OJL40,11.2.1989,p.12.(9)ThisRegulationshouldtakeaccountofthehorizontallegalframeworkforthemarketingofproductsintheinternalmarket,establishedbyRegulation(EC)No765/2008oftheEuropeanParliamentandoftheCouncilof9July2008settingouttherequirementsforaccreditationandmarketsurveillancerelatingtothemarketingofproducts(1)aswellasbyDecisionNo768/2008/ECoftheEuropeanParliamentandoftheCouncilof9July2008onacommonframeworkforthemarketingofproducts(2).(10)Theremovaloftechnicalbarriersinthefieldofconstructionmayonlybeachievedbytheestablishmentofharmonisedtechnicalspecificationsforthepurposesofassessingtheperformanceofconstructionproducts.(11)Thoseharmonisedtechnicalspecificationsshouldincludetesting,calculationandothermeans,definedwithinharmonisedstandardsandEuropeanAssessmentDocumentsforassessingperformanceinrelationtotheessentialcharacteristicsofconstructionproducts.(12)ThemethodsusedbytheMemberStatesintheirrequirementsforconstructionworks,aswellasothernationalrulesrelatingtotheessentialcharacteristicsofconstructionproducts,shouldbeinaccordancewithharmonisedtechnicalspecifications.(13)Whereappropriate,classesofperformanceinrelationtotheessentialcharacteristicsofconstructionproductsshouldbeencouragedtobeusedinharmonisedstandards,soastotakeaccountofdifferentlevelsofbasicrequirementsforconstructionworksforcertainconstructionworksaswellasofthedifferencesinclimate,geologyandgeographyandotherdifferentconditionsprevailingintheMemberStates.Onthebasisofarevisedmandate,theEuropeanstandardisationbodiesshouldbeentitledtoestablishsuchclassesincaseswheretheCommissionhasnotalreadyestablishedthem.(14)WhereanintendeduserequiresthresholdlevelsinrelationtoanyessentialcharacteristictobefulfilledbyconstructionproductsinMemberStates,thoselevelsshouldbeestablishedintheharmonisedtechnicalspecifications.(15)Whenassessingtheperformanceofaconstructionproduct,accountshouldalsobeta
