AmericanJudicialSystem第一张Goodafternooneveryone,thetopicofourgroupisAmericanjudicialsystem,themainpointofthispresentationisjuryprocedure.第二张firstofall,letmeintroducemyteammember,JinischargeofU.Ssupremecourtandjuryprocedure.Yangischargeoftwocasesaboutjuryprocedure,Firstandsixthbillofamendment.IamchargeofmakingthispresentationtoyouandshowingavideoaboutJuryprocedure,named12angrymen.第三张ThatisthejudicialbranchofU.S.federalgovernmentThisistheJudicialstructure,thecorepointsofthisstructuretheSupremeCourt13courtsofappeals94districtcourtstwocourtsofspecialjurisdiction第四张OrwecanseethesimpleoneThroughouttheUnitedStatestherearetwojudicialsystems.Onesystemconsistsofstateandlocalcourtsestablishedundertheauthorityofthestategovernments.TheotheristheSupremeCourtandthefederalcourtsystem,createdbyCongressundertheauthorityoftheConstitutionoftheUnitedStates.TheSupremeCourtisthehighestcourtinthefederalcourtsystemwhichwasestablishedin1789.BelowtheSupremeCourtarethecourtsofappeals,andbelowtheminturnarethedistrictcourts,whicharethegeneraltrialcourtsforfederallaw.Inaddition,therearetwocourtsofspecialjurisdictionNextmainpointisaboutTheAmericanJurysystemAboutO.J.Simpson'scaseBefore1994,NFLfootballplayerO.J.SimpsonmurdercasebecomewasAmerica'smostsensationalevents.Thecasewasthetrialoftwistsandturns,O.J.Simpsonwithaknifetokillhisex-wifeandrestaurantwaiterRonGormantwocountsoffirst-degreemurdercrimereferstocontrol,duetothepoliceafewblunderscausedstrongevidenceofthefailure,toacquitted,onlytobeciviljudgedtoberesponsibleforthedeathoftwopeople.ThecasehasalsobecomethehistoryoftheUnitedStatessuspectedcrimesinnocenceofthebiggestcaseTheRoleofJuryTrialsInmostcommonlawjurisdictions,thejuryisresponsibleforfindingthefactsofthecase,whilethejudgedeterminesthelaw.Thesepeersoftheaccusedareresponsibleforlisteningtoadispute,evaluatingtheevidencepresented,decidingonthefacts,andmakingadecisioninaccordancewiththerulesoflawandtheirjuryinstructions.Typically,thejuryonlyjudgesguiltoraverdictofnotguilty,buttheactualpenaltyissetbythejudge.IntheUnitedStates,becausejurytrialstendtobehighprofile,thegeneralpublictendstooverestimatethefrequencyofjurytrials.Approximately150,000jurytrialsareconductedinstatecourtsintheU.S.,andanadditional5,000jurytrialsareconductedinfederalcourts.Two-thirdsofjurytrialsarecriminaltrials,whileone-thirdarecivilandother(e.g.,family,municipalordinance,traffic).Nevertheless,thevastmajorityofcasesareinfactsettledbypleabargain,whichremovestheneedforajurytrial.Theplotof12AngryMenrevolvesaroundthemurdertrailofaLatinoboywhoisaccusedofkillinghisfather.Theconvictionoftheboywouldmeanadeathsentenceandthedestinyoftheboy'slifeisinthehandsoftwelvemalejurorsofrangingpersonalities.Thecaseseemsopenandshutwithamurderweaponandseveralwitnessestoplacetheboyatthesceneofthecrime.Forelevenofthejurorsthedecisionisapparentthattheboyisguiltybutforonejuror,Mr.Davis(HenryFonda),theboy'slifeshouldentailsomediscussiontoeliminateanyreasonabledoubtthejurorsmayhave.Asthefilmprogressesthepersonalitiesofthejurorsbecomeapparentandmanyunderlyingissuesinfluencetheguiltydecisionchosenbythemajorityofthejurors.Theunderlyingissuesarethecomplexityofthepersonalitiesofthejurorsandthereasonswhytheyhavethemotivationtofeelandactthewaytheydo.Asthecaseunfoldsfurther,moreislearnedabouteachjurorindividually.Thepersonalitiesrangefrombeingashort-temperedloudmouthtoastraight-lacedaccountantwhoneverbreaksasweat.Asthemovieprogressesmuchmoreislearnedofthecharactersthatexposestheintricacyofhumannatureandpeople'sdifferentpersonalitytraits.Thisfilmisanexcellentexampleofmoviemakingthatdoesnotrequireelaboratesetstoentertaintheviewer.Themajorityofthefilmtakesplaceinajuryroomwiththemenneverleavingtheroomfromtheirdeliberationresponsibilities.Thecastanddialoguemakethisfilmmemorableandthefilmhassomeclearmoralissuesthatareaddressed.Themainissueisthatnoteverythingisasitseems.Withfurtheranalysistheunderstandingofasituationbecomesmoreconcreteenablingthementomakeasoliddecisionthataffectsayoungman'slife.12AngryMenisaclassicfilmthatshouldnotbemissed.Fromwhathavebeendiscussedabove,wecansafelydrawtheconclusionthattheAmericanjurysystemhavethetwo-sided,butanythingexistingmustbereasonable.Thankyouforyourattention.
