II(Non-legislativeacts)REGULATIONSCOMMISSIONDELEGATEDREGULATION(EU)No874/2012of12July2012supplementingDirective2010/30/EUoftheEuropeanParliamentandoftheCouncilwithregardtoenergylabellingofelectricallampsandluminaires(TextwithEEArelevance)THEEUROPEANCOMMISSION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,HavingregardtoDirective2010/30/EUoftheEuropeanParliamentandoftheCouncilof19May2010ontheindi­cationbylabellingandstandardproductinformationoftheconsumptionofenergyandotherresourcesbyenergy-relatedproducts(1),andinparticularArticle10thereof,Whereas:(1)Directive2010/30/EUrequirestheCommissiontoadoptdelegatedactsasregardsthelabellingofenergy-relatedproductshavingsignificantpotentialforenergysavingsandawidedisparityinperformancelevelswithequivalentfunctionality.(2)ProvisionsontheenergylabellingofhouseholdlampswereestablishedbyCommissionDirective98/11/EC(2).(3)TheelectricityusedbyelectricallampsaccountsforasignificantshareoftotalelectricitydemandintheUnion.Inadditiontotheenergyefficiencyimprovementsalreadyachieved,thescopeforfurtherreducingtheenergyconsumptionofelectricallampsissubstantial.(4)Directive98/11/ECshouldberepealedandnewprovisionsshouldbesetoutinthisRegulationinordertoensurethattheenergylabelprovidesdynamicincentivesforsuppliersfurthertoimprovetheenergyefficiencyofelectricallampsandtospeedupthemarketshifttowardsenergy-efficienttechnologies.ThescopeofDirective98/11/ECislimitedtocertaintech­nologieswithinthecategoryofhouseholdlamps.Inordertousethelabeltoimprovetheenergyefficiencyofotherlamptechnologies,includinginprofessionallighting,thisRegulationshouldalsocoverdirectionallamps,extralowvoltagelamps,light-emittingdiodes,andlampsusedpredominantlyinprofessionallighting,suchashigh-intensitydischargelamps.(5)Luminairesareoftensoldwithincorporatedoraccom­panyinglamps.ThisRegulationshouldensurethatconsumersareinformedaboutthecompatibilityoftheluminairewithenergy-savinglampsandabouttheenergyefficiencyofthelampsincludedwiththeluminaire.Atthesametime,thisRegulationshouldnotimposeadisproportionateadministrativeburdenonluminairemanufacturersandretailers,norshoulditdiscriminatebetweenluminairesasregardstheobligationtoprovideconsumerswithinformationonenergyefficiency.(6)Theinformationprovidedonthelabelshouldbeobtainedthroughreliable,accurateandreproduciblemeasurementprocedures,whichtakeintoaccounttherecognisedstate-of-the-artmeasurementmethodsincluding,whereavailable,harmonisedstandardsadoptedbytheEuropeanstandardisationbodies,aslistedinAnnexItoDirective98/34/ECoftheEuropeanParliamentandoftheCouncil(3).(7)ThisRegulationshouldspecifyauniformdesignandcontentforthelabelforelectricallampsandluminaires.(8)Inaddition,thisRegulationshouldspecifyrequirementsforthetechnicaldocumentationofelectricallampsandluminairesandfortheficheofelectricallamps.EN26.9.2012OfficialJournaloftheEuropeanUnionL258/1(1)OJL153,18.6.2010,p.1.(2)OJL71,10.3.1998,p.1.(3)OJL204,21.7.1998,p.37.(9)Moreover,thisRegulationshouldspecifyrequirementsfortheinformationtobeprovidedforanyformofdistanceselling,advertisementsandtechnicalpromotionalmaterialsforelectricallampsandluminaires.(10)ItisappropriatetoprovideforareviewoftheprovisionsofthisRegulationtakingintoaccounttechnologicalprogress.(11)InordertofacilitatethetransitionfromDirective98/11/ECtothisRegulation,householdlampslabelledinaccordancewiththisRegulationshouldbeconsideredcompliantwithDirective98/11/EC.(12)Directive98/11/ECshouldthereforeberepealed,HASADOPTEDTHISREGULATION:Article1Subjectmatterandscope1.ThisRegulationestablishesrequirementsforlabellingofandprovidingsupplementaryproductinformationonelectricallampssuchas:(a)filamentlamps;(b)fluorescentlamps;(c)high-intensitydischargelamps;(d)LEDlampsandLEDmodules.ThisRegulationalsoestablishesrequirementsforlabellinglumi­nairesdesignedtooperatesuchlampsandmarketedtoendusers,includingwhentheyareintegratedintootherproductsthatarenotdependentonenergyinputinfulfillingtheirprimarypurposeduringuse(suchasfurniture).2.ThefollowingproductsshallbeexcludedfromthescopeofthisRegulation:(a)lampsandLEDmoduleswithaluminousfluxoflessthan30lumens;(b)lampsandLEDmodulesmarketedforoperationwithbatteries;(c)lampsandLEDmodulesmarketedforapplicationswheretheirprimarypurposeisnotlighting,suchas:(i)emissionoflightasanagentinchemicalorbiologicalprocesses(suchaspolimerisation,photodynamictherapy,horticulture,petcare,anti-insectproducts);(ii)imagecaptureandimageprojection(suchascameraflashlights,photocopiers,videoprojectors);(iii)heating(suchasinfraredlamps);(iv)signalling(suchasairfieldlamps).TheselampsandLEDmodulesarenotexcludedwhentheyaremarketedforlighting;(d)lampsandLEDmodulesmarketedaspartofaluminaireandnotintendedtoberemovedbytheend-user,exceptwhentheyareofferedforsale,hireorhirepurchaseordisplayedseparatelytotheenduser,forexampleasspareparts;(e)lampsandLEDmodulesmarketedaspartofaproductwhoseprimarypurposeisnotlighting.However,iftheyareofferedforsale,hireorhirepurchaseordisplayedsepar­ately,forexampleasspareparts,theyshallbeincludedwithinthescopeofthisRegulation;(f
