I(ActsadoptedundertheECTreaty/EuratomTreatywhosepublicationisobligatory)REGULATIONSREGULATION(EC)No661/2009OFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof13July2009concerningtype-approvalrequirementsforthegeneralsafetyofmotorvehicles,theirtrailersandsystems,componentsandseparatetechnicalunitsintendedtherefor(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle95thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)Theinternalmarketcomprisesanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured.Tothatend,acomprehensiveCommunitytype-approvalsystemformotorvehicles,establishedbyDirective2007/46/ECoftheEuropeanParliamentandoftheCouncilof5September2007establishingaframeworkfortheapprovalofmotorvehiclesandtheirtrailers,andofsystems,componentsandseparatetechnicalunitsintendedforsuchvehicles(FrameworkDirective)(3),isinplace.(2)ThisRegulationisaseparateregulationforthepurposesoftheCommunitytype-approvalprocedureprovidedforbyDirective2007/46/EC.Therefore,AnnexesIV,VI,XIandXVtothatDirectiveshouldbeamendedaccordingly.(3)ThisRegulationiswithoutprejudicetothevehiclesingle-stepandmixedtype-approvalproceduresetoutinArticle6ofDirective2007/46/EC.(4)Thetechnicalrequirementsforthetype-approvalofmotorvehicleswithregardtonumeroussafetyandenvironmentalelementshavebeenharmonisedatCommunitylevelinordertoavoidrequirementsthatdifferfromoneMemberStatetoanother,andtoensureahighlevelofroadsafetyandenvironmentalprotectionthroughouttheCommunity.(5)Therefore,thisRegulationalsoaimsatenhancingthecompetitivenessoftheCommunityautomotiveindustrywhilstenablingMemberStatestoexerciseeffectivemarketsurveillanceofcompliancewiththedetailedtype-approvalrequirementsofthisRegulationasregardstheplacingonthemarketoftheproductsconcerned.(6)Itisappropriatetosetoutrequirementsregardingboththegeneralsafetyofmotorvehiclesandtheenvironmentalperformanceoftyres,duetotheavailabilityoftyrepressuremonitoringsystemswhichenhanceatthesametimethesafetyandenvironmentalperformanceoftyres.(7)FollowingtherequestoftheEuropeanParliament,anewregulatoryapproachhasbeenappliedtoCommunityvehiclelegislation.ThisRegulationshouldthereforelaydownonlyfundamentalprovisionsonvehiclesafetyandCO2andnoiseemissionsfromtyres,whereasthetechnicalspecificationsshouldbelaiddownbyimplementingmeasuresadoptedinaccordancewithCouncilDecision1999/468/ECof28June1999layingdowntheproceduresfortheexerciseofimplementingpowersconferredontheCommission(4).EN31.7.2009OfficialJournaloftheEuropeanUnionL200/1(1)Opinionof14January2009(notyetpublishedintheOfficialJournal).(2)OpinionoftheEuropeanParliamentof10March2009(notyetpublishedintheOfficialJournal)andCouncilDecisionof22June2009.(3)OJL263,9.10.2007,p.1.(4)OJL184,17.7.1999,p.23.(8)Inparticular,theCommissionshouldbeempoweredtoestablishthespecificprocedures,testsandrequirementsforthetype-approvalofmotorvehicles,componentsandseparatetechnicalunits;todefinemorepreciselythecharacteristicsatyremustfulfiltobedefinedas‘specialusetyre’,‘off-roadprofessionaltyre’,‘reinforcedtyre’,‘extraloadtyre’,‘snowtyre’,‘T-typetemporary-usesparetyre’or‘tractiontyre’;tosetoutspecificsafetyrequirementsforvehiclesintendedforthetransportofdangerousgoodsbyroadwithinorbetweenMemberStates;toexemptcertainvehiclesorclassesofvehiclesofcategoriesM2,M3,N2andN3fromtheobligationtoinstalladvancedemergencybrakingsystemsand/orlanedeparturewarningsystems;toamendthelimitvaluesonrollingresistanceandrollingnoisefortyresasaresultofchangesintestprocedureswithoutloweringthelevelofprotectionoftheenvironment;toestablishrulesontheprocedureforthedeterminationofnoiselevelsoftyres;toshortenthesell-offperiodfortyresnotcomplyingwiththerequirementssetoutinthisRegulationanditsimplementingmeasures;andtoamendAnnexIVtoincludetheRegulationsoftheUnitedNationsEconomicCommissionforEurope(UNECERegulations)whicharemandatoryunderCouncilDecision97/836/ECof27November1997withaviewtoaccessionbytheEuropeanCommunitytotheAgreementoftheUnitedNationsEconomicCommissionforEuropeconcerningtheadoptionofuniformtechnicalprescriptionsforwheeledvehicles,equipmentandpartswhichcanbefittedtoand/orbeusedonwheeledvehiclesandtheconditionsforreciprocalrecognitionofapprovalsgrantedonthebasisoftheseprescriptions(1).Sincethosemeasuresareofgeneralscopeandaredesignedtoamendnon-essentialelementsofthisRegulation,interalia,bysupplementingitwithnewnon-essentialelements,theymustbeadoptedinaccordancewiththeregulatoryprocedurewithscrutinyprovidedforinArticle5aofDecision1999/468/EC.(9)InadditiontotheongoingCommissioninitiativeaimingatdefiningaroadgradingsystem,theCommissionshould,within12monthsoftheentryintoforceofthisRegulation,bringforwardaproposalontheclassificationofEUroadsaccordingtonoisegenerationthatwillcomplementnoisemappinginmotorvehicletransportationwithaviewtofixingappropriat
