DIRECTIVE2004/12/ECOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof11February2004amendingDirective94/62/EConpackagingandpackagingwasteTHEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEURO-PEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle95(1)thereof,HavingregardtotheproposalfromtheCommission(1),HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(2),ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty,inthelightofthejointtextapprovedbytheConciliationCommitteeon17December2003(3),Whereas:(1)PursuanttoDirective94/62/EC(4)theCouncilisrequired,nolaterthansixmonthsbeforetheendofafive-yearphasestartingfromthedatebywhichthatDirectiveshouldhavebeenimplementedinnationallaw,tofixtargetsforthenextfive-yearphase.(2)Thedefinitionof‘packaging’laiddowninDirective94/62/ECshouldbefurtherclarifiedthroughtheintroduc-tionofcertaincriteriaandanannexcontainingillustra-tiveexamples.Itisnecessary,inordertoachievetheambitiousrecyclingtargets,toencouragethedevelop-mentofinnovative,environmentallysoundandviablerecyclingprocesses.Anevaluationofthedifferentrecy-clingmethodsshouldbemadewithaviewtodrawingupdefinitionsforthesemethods.(3)Recyclingtargetsforeachspecificwastematerialshouldtakeaccountoflife-cycleassessmentsandcost-benefitanalysis,whichhaveindicatedcleardifferencesbothinthecostsandinthebenefitsofrecyclingthevariouspackagingmaterials,andshouldimprovethecoherenceoftheinternalmarketfortherecyclingofthesemate-rials.(4)Recoveryandrecyclingofpackagingwasteshouldbefurtherincreasedtoreduceitsenvironmentalimpact.(5)CertainMemberStateswhich,onaccountoftheirspecialcircumstances,wereallowedtopostponethedatefixedforachievementoftherecoveryandrecyclingtargetssetinDirective94/62/ECshouldbegrantedafurther,butlimited,postponement.(6)TheEuropeanParliament,theCouncilandtheCommis-sionagreeontheneedfortemporaryderogationsfortheaccedingStateswithrespecttothetargetsofthisDirective.ThisshouldbedecidedonthebasisoftherequestsfromtheaccedingStatesforderogationstoruninprincipleuntilnotlaterthan2012forCyprus,theCzechRepublic,Estonia,Hungary,Lithuania,SlovakiaandSlovenia;2013forMalta;2014forPolandand2015forLatvia.(7)ThisagreementwillbefinalisedinaccordancewiththeappropriatelegalprocedurebeforetheexpiryofthedeadlineforthetranspositionofthisDirective.(8)ThemanagementofpackagingandpackagingwasterequirestheMemberStatestosetupreturn,collectionandrecoverysystems.Suchsystemsshouldbeopentotheparticipationofallinterestedpartiesandbedesignedtoavoiddiscriminationagainstimportedproductsandbarrierstotradeordistortionsofcompetitionandtoguaranteethemaximumpossiblereturnofpackagingandpackagingwaste,inaccordancewiththeTreaty.Discriminationagainstmaterialsonthebasisoftheirweightshouldbeavoided.Theoperatorsinthepacka-gingchainasawholeshouldshouldertheirsharedresponsibilitytoensurethattheenvironmentalimpactofpackagingandpackagingwastethroughoutitslifecycleisreducedasfaraspossible.(9)AnnualCommunity-widedataonpackagingandpacka-gingwaste,includingonwasteexportedforrecyclingandrecoveryoutsidetheCommunity,areneededinordertomonitortheimplementationoftheobjectivesofthisDirective.Thisrequiresaharmonisedreportingtech-niqueandclearguidelinesfordataproviders.(10)TheCommissionshouldexamineandreportontheimplementationofthisDirectiveanditsimpactonboththeenvironmentandtheinternalmarket.Thisreportshouldalsocovertheissuesofessentialrequirements,wastepreventionmeasures,apossiblepackagingindi-cator,wastepreventionplans,reuse,producerresponsi-bilityandheavymetalandshould,asappropriate,beaccompaniedbyproposalsforrevision.18.2.2004L47/26OfficialJournaloftheEuropeanUnionEN(1)OJC103E,30.4.2002,p.17.(2)OJC221,17.9.2002,p.31.(3)OpinionoftheEuropeanParliamentof3September2002(OJC272E,13.11.2003,p.287),CouncilCommonPositionof6March2003(OJC107E,6.5.2003,p.17),PositionoftheEuropeanParliamentof2July2003(notyetpublishedintheOfficialJournal).LegislativeresolutionoftheEuropeanParliamentof29January2004andCouncilDecisionof26January2004.(4)OJL365,31.12.1994,p.10.DirectiveasamendedbyRegulation(EC)No1882/2003(OJL284,31.10.2003,p.1).(11)MemberStatesshouldpromoterelevantconsumerinfor-mationandawarenesscampaignsandencourageotherpreventioninstruments.(12)InadditiontotheenvironmentalandinternalmarketobjectivesofthisDirective,recyclingmayalsohavetheeffectofprovidingjobswhichhavedeclinedelsewhereinsociety,andmaythushelppreventexclusion.(13)Sincetheobjectivesoftheproposedaction,namelytoharmonisenationaltargetsfortherecyclingofpackagingwaste,takingintoaccountindividualcircumstancesofeachMemberState,andtoprovidefurtherclarificationondefinitions,cannotbesufficientlyachievedbytheMemberStatesandcantherefore,byreasonofthescaleoftheaction,bebetterachievedatCommunitylevel,theCommunitymayadoptmeasures,inaccordancewiththeprincipleofsubsidiarityassetoutinArticle5oftheTreaty.Inaccordancewiththeprincipleofproportion-ality,assetoutinthatArticle,thisDirectivedoesnotgobeyondwhatisnecessaryinordertoachievethoseobjectives.(14)ThemeasuresnecessaryfortheimplementationofthisDirectiveshouldbeadoptedi
