中华人民共和国电力法(英文版)ElectricityLawofthePeople'sRepublicofChina(Dec.28,1995)WholedocumentElectricityLawofthePeople'sRepublicofChinaChapterIGeneralProvisionsArticle1Thislawisformulatedtoguaranteeandpromotethedevelopmentoftheelectricpowerindustry,tosafeguardthelegalrightsandinterestsofinvestors,operatorsandusersofelectricpower,andtomaintainthesafeoperationofelectricpower.Article2Thislawisapplicabletoactivitiesconcerningtheconstruction,production,supplyandutilizationofelectricpowerwithintheboundariesofthePeople'sRepublicofChina.Article3Theelectricpowerindustryshallfittheneedsofnationaleconomyandsocialdevelopmentanddevelopinadvanceappropriately.TheStateencouragesandguideslegalinvestmentinthedevelopmentofpowersourcesandtheestablishmentofpowerproductionenterprisesbydomesticandoverseaseconomicorganizationsorindividuals.Investmentinthepowerindustryshallimplementtheprincipleofwhoeverinvests,benefits.Article4ElectricpowerfacilitiesshallbeundertheprotectionoftheState.Itisforbiddenforanyunitorindividualtoendangerthesafetyofelectricpowerfacilitiesortoillegallyoccupyorutilizeelectricenergy.Article5Theconstruction,production,supplyandutilizationofelectricpowershallprotecttheenvironmentaccordingtolaw,adoptnewtechnologies,minimizedischargeofpoisonouswaste,andpreventpollutionandotherpublichazards.TheStateencouragesandsupportselectricitygenerationbyusingrenewableandcleanenergyresources.Article6TheadministrativedepartmentofelectricpowerundertheStateCouncilshallberesponsibleforthesupervisionandcontroloftheelectricpowerindustrythroughoutthecountry.ThedepartmentsconcernedundertheStateCouncilshall,withinthescopeoftheirrespectiveauthorities,beresponsibleforthesupervisionandcontrolofelectricpowerindustry.Thecomprehensiveadministrativedepartmentsofeconomyunderthelocalpeople'sgovernmentsatandabovethecountylevel,actingastheadministrativedepartmentsofelectricpowerintheirownadministrativedivisions,shallberesponsibleforthesupervisionandcontroloftheelectricpowerindustry.Thedepartmentsconcernedunderthelocalpeople'sgovernmentsatandabovethecountylevelshall,withinthescopeoftheirrespectiveauthorities,beresponsibleforthesupervisionandcontrolofelectricpowerindustry.Article7Electricpowerconstructionenterprises,productionenterprisesandnetworkoperationenterprisesshalloperateautonomously,beresponsiblefortheirownprofitsandlosses,andbesubjecttothesupervisionoftheadministrativedepartmentsofelectricpower,accordingtolaw.Article8TheStateassistsandsupportsminoritynationalityareas,frontierandremoteareas,andpoverty-strickenareastodeveloptheirelectricpowerindustries.Article9TheStateencouragestheadoptionofadvancedscienceandtechnologyaswellasmanagerialmethodsintheconstruction,production,supplyandutilizationofelectricpower,andgivesawardstothoseunitsandindividualsthatachieveremarkablesuccesseswithregardtoresearch,development,andadoptionofadvancedscienceandtechnologyaswellasmanagerialmethods.ChapterIIConstructionofElectricPowerArticle10Theplanningforelectricpowerdevelopmentshallbedrawnuponthebasisoftherequirementsofnationaleconomyandsocialdevelopmentandshallbeputintotheplanofnationaleconomyandsocialdevelopment.Theplanningforelectricpowerdevelopmentshallreflecttheprinciplesofrationalutilizationofenergy,coordinateddevelopmentofthepowersourcesandpowernetworks,increasingeconomicbenefits,andbeingconducivetoenvironmentalprotection.Article11Theconstructionandretrofitplanningofurbanpowernetworksshallbeputintotheoverallurbanplanning.Theurbanpeople'sgovernmentsshallarrangetoprovidelandforsubstationfacilities,transmissionlinecorridors,andcablechannelsinaccordancewiththeplanning.Nounitorindividualmayillegallyoccupyorutilizethelanddesignatedtosubstationfacilities,transmissionlinecorridors,andcablechannels.Article12TheStateformulatesrelevantpoliciestosupportandpromoteelectricpowerconstruction.Thelocalpeople'sgovernmentsshalladoptdiversifiedmeasuresinlinewithlocalconditionstodeveloppowersourcesandpromotepowerconstructiononthebasisoftheelectricpowerdevelopmentplanning.Article13Investorsinelectricpowershallenjoylegalrightsandinterestsovertheelectricitygeneratedfromtheirinvestment.Whereelectricitythusgeneratedfeedsintothepowernetwork,theinvestorshallhavethepriorityinutilization;whereacaptivepowerplantisnotinparalleloperationwiththepowernetwork,theinvestorshallhavetheauthorityindecidingtheutilizationonitsown.Article14PowerconstructionprojectsshallconformtotheelectricpowerdevelopmentplanningaswellastheState'sindustrialpoliciesonthepowerindustry.NopowerequipmentandtechnologydeclaredobsoletebyformaldecreeoftheStateshallbeusedforpowerconstructionprojects.Article15Projectsforpowernetworkssuchastransmission,substation,powerdispatchingtelecommunicationandautomationprojects,andenvironmentalprotectionprojects,shallbedesigned,constructed,inspectedforacceptanceandputintooperationsimultaneouslywithelectricitygenerationprojects.Article16Landusedforpowerconstructionprojectsshallbehandledinaccordancewithrelevantlawsandadministrativeregulations;andinthecasewherethelandislegallyrequisitioned,thelandcompens
