美国联邦法规16CFR1500.48供8岁以下儿童使用的玩具或类似品中尖点的测定的技术要求原文出处:作者:编辑:[2009-02-25][打印文章][关闭窗口]§1500.48Technicalrequirementsfordeterminingasharppointintoysandotherarticlesintendedforusebychildrenunder8yearsofage.(a)Objective.Thesharppointtestprescribedbyparagraph(d)ofthissectionwillbeusedbytheCommissioninmakingapreliminarydeterminationthatpointsontoysandotherarticlesintendedforusebychildrenunder8yearsofage,andsuchpointsexposedinnormaluseorasaresultofreasonablyforeseeabledamageorabuseofsuchtoysandarticles,presentapotentialriskofinjurybypunctureorlacerationundersection2(s)oftheFederalHazardousSubstancesAct(15U.S.C.1261(s)).TheCommissionwillfurtherevaluatepointsthatareidentifiedaspresentingapotentialriskofpunctureorlacerationinjurytodeterminetheneedforindividualproductregulatoryaction.(b)Scope—(1)General.Thesharppointtestofparagraph(d)ofthissectionisapplicabletotoysorotherarticlesthatareintroducedintointerstatecommerceonorafterDecember22,1978.Thesharppointtestshallbeappliedtoanyaccessibleportionofthetestsamplebeforeandaftersubjectingthetestsampletotheuseandabusetestsof§§1500.51,1500.52,and1500.53(excludingthebitetest-paragraph(c)ofeachsection).(2)Exemptions.(i)Toysandotherchildren'sarticlesthatarethesubjectofanyofthefollowingregulationsareexemptfromthis§1500.48:Theregulationsforbicycles,non-full-sizebabycribs,andfull-sizebabycribs(parts1508,1509,and1512,ofthischapter).(ii)Toysthatbyreasonoftheirfunctionalpurposenecessarilypresentthehazardofsharppointsandthatdonothaveanynonfunctionalsharppointsareexemptfromthis§1500.48:Provided,Eachtoyisidentifiedbyaconspicuous,legible,andvisiblelabelatthetimeofanysale,ashavingfunctionalsharppoints.Anexampleofsuchtoysisatoysewingmachinewithaneedle.(iii)Articles,besidestoys,intendedforusebychildrenthatbyreasonoftheirfunctionalpurposenecessarilypresentthehazardofsharppointsandthatdonothaveanynonfunctionalsharppointsareexemptfromthis§1500.48.Anexampleofsucharticlesisaball-pointpen.(c)Accessibility—(1)General.Anypointthatisaccessibleeitherbeforeorafterthesetestsof§1500.51,§1500.52,and§1500.53(excludingthebitetest—paragraph(c)ofeachsection)areperformedshallbesubjecttothesharppointtestofparagraph(d)ofthissection.(2)Accessiblepoints.(i)Anaccessiblepointforatoyorarticleintendedforchildren3yearsofageorlessisonethatcanbecontactedbyanyportionforwardofthecollaroftheaccessibilityprobedesignatedasprobeAinfigure2ofthissection.(ii)Anaccessiblepointforatoyorarticleintendedforchildrenover3yearsupto8yearsofageisonethatcanbecontactedbyanyportionforwardofthecollaroftheaccessibilityprobedesignatedasprobeBinfigure2ofthissection.(iii)AnaccessiblepointforatoyorarticleintendedforchildrenofagesspanningbothagegroupsisonethatcanbecontactedbyanyportionforwardofthecollarofeitherprobeAorB,asshowninfigure2ofthissection.(3)Insertiondepthforaccessibility.(i)Foranyhole,recess,oropeninghavingaminordimension(Theminordimensionofanopeningisthediameterofthelargestspherethatwillpassthroughtheopening.)smallerthanthecollardiameteroftheappropriateprobe,thetotalinsertiondepthforaccessibilityshallbeuptothecollarontheappropriateprobe.Eachprobejointmayberotatedupto90degreestosimulateknucklemovement.(ii)Foranyhole,recess,oropeninghavingaminordimensionlargerthanthecollardiameterofprobeAbutlessthan7.36inches(186.9millimeters),whenprobeAisused,oraminordimensionlargerthanthecollardiameterofprobeBbutlessthan9.00inches(228.6millimeters),whenprobeBisused,thetotalinsertiondepthforaccessibilityshallbedeterminedbyinsertingtheappropriateprobewiththeextensionshowninfigure2inanydirectionuptotwoandone-quartertimestheminordimensionoftheprobe,recess,oropening,measuredfromanypointintheplaneoftheopening.Eachprobejointmayberotatedupto90degreestosimulateknucklemovement.(iii)Foranyhole,recess,oropeninghavingaminordimensionof7.36inches(186.9millimeters)orlargerwhenprobeAisused,oraminordi-mensionof9.00inches(228.6millimeters),orlargerwhenprobeBisused,thetotalinsertiondepthforaccessibilityisunrestrictedunlessotherholes,recesses,oropeningswithintheoriginalhole,recess,oropeningareencounteredwithdimensionsspecifiedinparagraph(c)(3)(i)or(ii)ofthissection.Insuchinstances,theappropriateparagraphs(c)(3)(i)or(ii)ofthissectionshallbefollowed.Ifbothprobesaretobeused,aminordimen-sionthatis7.36inches(186.9millimetersorlargershalldetermineunrestrictedaccess.(4)Inaccessiblepoints.Pointsshallbeconsideredinaccessiblewithouttestingwithaprobeiftheylieadjacenttoasurfaceofthetestsampleandanygapbetweenthepointandtheadjacentsurfacedoesnotexceed0.020inch(0.50millimeter)eitherbeforeorafterthetestsof§§1500.51,1500.52,and1500.53(excludingthebitetest—paragraph(c)ofeachsection)areperformed.(d)Sharppointtestmethod—(1)Principleofoperation.Theprincipleofoperationofthesharppointtestershowninfigure1ofthissectionisasfollows(DetailedengineeringdrawingsforasuggestedsharppointtesterareavailablefromtheCommission'sOfficeoftheSecretary.):Arectangularopeningmeasuring0.040inch(1.02millimeters)wideby0.045inch(1.15millimeters)longintheendoftheslottedcapestablishestworeferencedimensions.Depthofpenetrationofth
