美国联邦法规16CFR1500.49供8岁以下儿童使用的玩具或类似品中金属或玻璃利边的测定的技术要求原文出处:作者:编辑:[2009-02-25][打印文章][关闭窗口]1500.49Technicalrequirementsfordeterminingasharpmetalorglassedgeintoysandotherarticlesintendedforusebychildrenunder8yearsofage.(a)Objective.Thesharpedgetestmethodprescribedbyparagraph(d)ofthissectionwillbeusedbytheCommissioninmakingapreliminarydeterminationthatmetalorglassedgesontoysandotherarticlesintendedforusebychildrenunder8yearsofage,andsuchedgesexposedinnormaluseorasaresultofreasonablyforseeabledamageorabuseofsuchtoysandarticles,presentapotentialriskofinjurybylacerationoravulsionundersection2(s)oftheFederalHazardousSubstancesAct(15U.S.C.1261(s)).TheCommissionwillfurtherevaluatetoysandotherarticleswithedgesthatareidentifiedaspresentingapotentialriskoflacerationoravulsioninjurytodeterminetheneedforindividualproductregulation.(b)Scope—(1)General.Thesharpedgetestofparagraph(d)ofthissectionisapplicabletotoysorotherarticlescontainingmetalorglassedgesthatareintroducedintointerstatecommerceafterMarch26,1979.SucharticlesmanufacturedoutsidetheUnitedStatesareintroducedintointerstatecommercewhenfirstbroughtwithinasU.S.portofentry.SucharticlesmanufacturedintheUnitedStatesareintroducedintointerstatecommerce(a)atthetimeoffirstinterstatesale,or(b)atthetimeoffirstintrastatesaleifoneormorecomponentsand/orrawmaterialswerereceivedinterstate,whicheveroccursearlier.(2)Exemptions.(i)Toysandotherchildren'sarticlesthatarethesubjectofanyofthefollowingregulationsareexemptfromthis§1500.49:Theregulationsforbicycles,non-full-sizebabycribs,andfull-sizebabycribs(parts1508,1509,and1512ofthischapter).(ii)Toysthatbyreasonoftheirfunctionalpurposenecessarilypresentthehazardofsharpmetalorglassedgesandthatdonothaveanynonfunctionalsharpmetalorglassedgesareexemptfromthissection:Provided,thetoyisidentifiedbyaconspicuous,legible,andvisiblelabelatthetimeofanysale,ashavingfunctionalsharpmetalorglassedges.Examplesoftheseareapairoftoyscissorsandtoytoolkits.(iii)Articles,besidestoys,intendedforusebychildrenthatbyreasonoftheirfunctionalpurposenecessarilypresentthehazardofsharpmetalorglassedgesandthatdonothaveanynon-functionalsharpmetalorglassedgesareexemptfromthissection.Examplesofthesearechildren'siceskatesandchildren'scutlery.(3)Definitions—(i)Glass.ForthepurposeofthisregulationtheCommissiondefinesglassasahard,brittle,amorphoussubstanceproducedbyfusion,usuallyconsistingofmutuallydissolvedsilicaandsilicatesthatalsocontainsodaandlime.(ii)Metal.ForthepurposeofthisregulationtheCommissionintendsthewordmetaltoincludebothelementalmetalsandmetalalloys.(c)Accessibility—(1)General.Anymetalorglassedgethatisaccessibleeitherbeforeorafterthetestof§§1500.51,1500.52,and1500.53(excludingthebitetest—paragraph(c)ofeachsection)areperformedshallbesubjecttothesharpedgetestofparagraph(d)ofthissection.Toysreasonablyintendedtobeassembledbyanadultandnotintendedtobetakenapartbyachildshallbetestedonlyintheassembledstateiftheshelfpackageandtheassemblyinstructionsprominentlyindicatethatthearticleistobeassembledonlybyanadult.(2)Accessibleedges.(i)Anaccessiblemetalorglassedgeforatoyorarticleintendedforchildren3yearsofageorlessisonethatcanbecontactedbyanyportionforwardofthecollaroftheaccessibilityprobedesignatedasprobeAinFigure2ofthissection.(ii)Anaccessibleedgeforatoyorarticleintendedforchildrenover3yearsandupto8yearsofageisonethatcanbecontactedbyanyportionforwardofthecollaroftheaccessibilityprobedesignatedasProbeBinFigure2ofthissection.(iii)AnaccessibleedgeforatoyorarticleintendedforchildrenofagesspanningbothagegroupsisonethatcanbecontactedbyanyportionforwardofthecollarofeitherProbeAorProbeB,asshowninFigure2ofthissection.(3)Insertiondepth.(i)Foranyhole,recess,oropeninghavingaminordimension(theminordimensionofanopeningisthediameterofthelargestspherethatwillpassthroughtheopening),smallerthanthecollardiameteroftheappropriateprobe,thetotalinsertiondepthforaccessibilityshallbeuptothecollarontheappropriateprobe.Eachprobejointmayberotatedupto90degreestosimulateknucklemovement.(ii)Foranyhole,recess,oropeninghavingaminordimensionlargerthanthecollardiameterofProbeA,butlessthan7.36inches(186.9millimeters),whenProbeAisused,oraminordimensionlargerthanthecollardiameterofProbeB,butlessthan9.00inches(228.6millimeters),whenProbeBisused,thetotalinsertiondepthforaccessibilityshallbedeterminedbyinsertingtheappropriateprobewiththeextension,showninFigure2,inanydirectionupto21/4timestheminordimensionofthehole,recess,oropening,measuredfromanypointintheplaneoftheopening.Eachprobejointmayberotatedupto90degreestosimulateknucklemovement.(iii)Foranyhole,recess,oropeninghavingaminordimensionof7.36inches(186.9millimeters)orlargerwhenProbeAisused,oraminordimensionof9.00inches(228.6millimeters)orlargerwhenProbeBisused,thetotalinsertiondepthforaccessibilityisunrestrictedunlessotherholes,recesses,oropeningswithintheoriginalhole,recess,oropeningareencounteredwithdimensionsspecifiedinparagraph(c)(3)(i)or(ii)ofthissection.Insuchinstances,theappropriateparagraphs(c)(3)(i)or(ii)ofthissectionshallbefollowed.Ifbothprobesaretobeused,ami
