II(Non-legislativeacts)REGULATIONSCOMMISSIONREGULATION(EU)No1194/2012of12December2012implementingDirective2009/125/ECoftheEuropeanParliamentandoftheCouncilwithregardtoecodesignrequirementsfordirectionallamps,lightemittingdiodelampsandrelatedequipment(TextwithEEArelevance)THEEUROPEANCOMMISSION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,HavingregardtoDirective2009/125/ECoftheEuropeanParliamentandoftheCouncilof21October2009establishingaframeworkforthesettingofecodesignrequirementsforenergy-relatedproducts(1),andinparticularArticle15(1)thereof,AfterconsultingtheEcodesignConsultationForum,Whereas:(1)Directive2009/125/ECrequirestheCommissiontosetecodesignrequirementsforenergy-relatedproductsrepresentingsignificantvolumesofsalesandtrade,havingasignificantenvironmentalimpactandpresentingsignificantpotentialforimprovementthroughdesignintermsoftheirenvironmentalimpact,withoutentailingexcessivecosts.(2)Article16(2)(a)ofDirective2009/125/ECprovidesthatinaccordancewiththeprocedurereferredtoinArticle19(3)andthecriteriasetoutinArticle15(2),andafterconsultingtheEcodesignConsultationForum,theCommissionhasto,asappropriate,introduceimplementingmeasuresstartingwiththoseproductsthatofferahighpotentialforcost-effectivereductionofgreenhousegasemissions,suchaslightingproductsinboththedomesticandtertiarysectors,whichincludedirectionallamps,light-emittingdiodelampsandrelatedequipment.(3)TheCommissionhascarriedoutapreparatorystudytoanalysethetechnical,environmentalandeconomicaspectsofdirectionallamps,light-emittingdiodelampsandrelatedequipment.ThestudyhasbeendevelopedtogetherwithstakeholdersandinterestedpartiesfromtheUnionandthirdcountries,andtheresultshavebeenmadepubliclyavailable.Apreparatorystudyonexternalpowersuppliesprovidedasimilaranalysisforhalogenlampcontrolgear.(4)MandatoryecodesignrequirementsapplytoproductsplacedontheUnionmarketwherevertheyareinstalledorused;thereforesuchrequirementscannotbemadedependentontheapplicationinwhichtheproductisused.(5)ProductssubjecttothisRegulationaredesignedessentiallyforthefullorpartialilluminationofanarea,byreplacingorcomplementingnaturallightwithartificiallight,inordertoenhancevisibilityinthatarea.Specialpurposelampsdesignedessentiallyforothertypesofapplication,suchastrafficsignals,terrariumlightingorhouseholdappliancesandclearlyindicatedassuchonaccompanyingproductinformationshouldnotbesubjecttotheecodesignrequirementssetoutinthisRegulation.(6)Newtechnologiesemergingonthemarketsuchaslight-emittingdiodesshouldbesubjecttothisRegulation.(7)TheenvironmentalaspectsoftheproductscoveredthathavebeenidentifiedassignificantforthepurposesofthisRegulationareenergyconsumptionintheusephasealongwithmercurycontentandmercuryemissions.(8)Mercuryemissionsinthedifferentphasesofthelifecycleofthelamps,includingfromelectricitygenerationintheusephaseandfromthe80%ofdirectionalcompactfluorescentlampscontainingmercurywhichareEN14.12.2012OfficialJournaloftheEuropeanUnionL342/1(1)OJL285,31.10.2009,p.10.presumednottoberecycledattheendoftheirlife,havebeenestimatedtobe0,7tonnesin2007fromtheinstalledstockoflamps.Withouttakingspecificmeasures,themercuryemissionsfromtheinstalledlampstockarepredictedtoincreaseto0,9tonnesin2020,althoughithasbeendemonstratedthattheycanbesignificantlyreduced.(9)Althoughthemercurycontentofcompactfluorescentlampsisconsideredtobeasignificantenvironmentalaspect,itisappropriatetoregulateitunderDirective2011/65/EUoftheEuropeanParliamentandoftheCouncil(1).ItisappropriatetoregulatetheultravioletlightemissionsfromlampsandotherparameterswithpotentialhealtheffectsunderDirectives2006/95/EC(2)and2001/95/EC(3)oftheEuropeanParliamentandoftheCouncil.(10)Settingenergyefficiencyrequirementsforlampsshouldleadtoadecreaseintheoverallmercuryemissions.(11)Article14(2)(d)ofDirective2012/19/EUoftheEuropeanParliamentandoftheCouncil(4)requiresMemberStatestoensurethatusersofelectricalandelectronicequipmentinprivatehouseholdsaregiventhenecessaryinformationaboutthepotentialeffectsontheenvironmentandhumanhealthasaresultofthepresenceofhazardoussubstancesinelectricalandelectronicequipment.TheproductinformationrequirementsinthisRegulationshouldcomplementthisprovisionasregardsmercuryincompactfluorescentlamps.(12)TheelectricityconsumptionofproductssubjecttothisRegulationshouldbeimprovedbyapplyingexistingnon-proprietarycost-effectivetechnologies,whichleadtoareductionofthecombinedexpensesforpurchasingandoperatingtheequipment.(13)EcodesignrequirementsforproductssubjecttothisRegulationshouldbesetwithaviewtoimprovingtheenvironmentalperformanceoftheproductsconcernedandcontributingtothefunctioningoftheinternalmarketandtotheUnionobjectiveofreducingenergyconsumptionby20%in2020comparedwiththeassumedenergyconsumptioninthatyearifnomeasuresweretaken.(14)ThecombinedeffectoftheecodesignrequirementssetoutinthisRegulationandofCommissionDelegatedRegulation(EU)No874/2012(5)isexpectedtoresultinannualelectricitysavingsof25TWhby2020amongdirectionallamps,comparedwiththesituationifnomeasuresweretaken.(15)Theecodesignrequirementsshouldn
