Regulations on the Control over Safety of Dangerous Chemicals RegulationsontheControloverSafetyofDangerousChemicalsDecreeNo.591oftheStateCouncilofthePeople'sRepublicofChinaRegulationsontheControloverSafetyofDangerousChemicalshavebeenrevisedbythe144ndExecutiveMeetingoftheStateCouncilon16thFebruary2011.WeherebyissuethisrevisedRegulations,whichshalltakeeffectasof1thDecember2011.Premier:WenJiabao2ndMarch2011 (DecreeNo.344oftheStateCouncilofthePeople'sRepublicofChinawasissuedon26thJanuary2002,andrevisedbythe144ndExecutiveMeetingoftheStateCouncilon16thFebruary2011)ContentsChapterIGeneralPrinciples........................................................................................................................................2ChapterⅡSafetyofManufactureandStorage............................................................................................................6ChapterⅢSafetyofUse............................................................................................................................................12ChapterⅣSafetyofOperation..................................................................................................................................13ChapterⅤSafetyofTransportation..........................................................................................................................17ChapterVIRegistrationofDangerousChemicalsandEmergencyRescueofAccidents..........................................23ChapterVIILegalLiability........................................................................................................................................26ChapterVIIISupplementaryRules............................................................................................................................38Unofficial Translation Prepared by Dow & Ann Consulting Ltd Page 1 / 39 Regulations on the Control over Safety of Dangerous Chemicals ChapterIGeneralPrinciplesArticle1Inordertostrengthenthecontroloversafetyofdangerouschemicals,topreventandreducetheaccidentsfromdangerouschemicals,toguaranteethepeople’slifeandpropertysafety,andtoprotecttheenvironment,theseRegulationsareherebyenacted.Article2Thesafetyadministrationofproduction,storage,use,operationandtransportationofdangerouschemicalswereappliedtothisordinance.Thedisposalofthewasteddangerouschemicalsshallbegovernedbytherelevantlaws,otheradministrativeregulationsandnationalprovisionsconcerningaboutenvironmentalsafety.Article3“Dangerouschemicals”asreferredtohereinincludetoxicchemicalsandotherchemicalswhichhavethepropertiesofpoison,corrosion,explosion,burningandcombustionsupportingetc.,andwillbeharmfulforhumanbody,facilitiesandenvironment.TheListofDangerousArticlesshouldbedetermined,promulgatedandadjustedaccordingwiththeidentificationandclassificationoftheirriskcharacteristicsbytheadministrativedepartmentinchargeofproductionsafetysupervisionandmanagementjointlywiththeadministrativedepartmentsofindustryandinformationtechnology,publicsecurity,environmentalprotection,health,qualitysupervisioninspectionandquarantine,transportation,railway,civilaviationandagricultureetc.oftheStateCouncil.Article4Themanagementofdangerouschemicalsshouldadheretosafetyandpreventionfirst,comprehensivetreatmentapproachtostrengthenandimplementthemainresponsibilityofenterprises.Thepersonnelchieflyinchargeofunitsthatmanufacture,store,use,dealinandtransportofthedangerouschemicals(hereinafterreferredtoasthe“unitsofdangerouschemicals”)mustguaranteetheoverallsafetyadministration.Theunitsofdangerouschemicalsshallmeetthesafetyrequirementsoflaws,administrativeregulations,industrialstandards,andestablishandcompletethemanagementrulesandregulations,jobsafetyresponsibilitysystem,theiremployeesmusttakepartinthetrainingfortherelevantsafety,legalandpoststechnicalknow-how.Allemployedpersonsshallbeeducatedandtrained,onlythosepassingtheexaminationmayholdtheirposts;ForqualifiedUnofficial Translation Prepared by Dow & Ann Consulting Ltd Page 2 / 39 Regulations on the Control over Safety of Dangerous Chemicals positions,onlythepersonshavingrelevantcertificatesmayholdtheposts.Article5Anyunitsandpersonnelshouldnotmanufacture,dealin,useofthedangerouschemicalsthattheirproduction,operationandusearebannedbytheState.FortheuseofthedangerouschemicalsthatrestrictedbytheprovisionsoftheState,anyunitsandpersonsshouldnotviolatetherestrictionstousesuchchemicals.Article6Therelevantdepartmentsinchargeofsupervisionandadministrationofthemanufacture,storage,use,operation,transportationofdangerouschemicals(hereinafterreferredtoasthe“departmentsinchargeofsupervisionandadministrationofdangerouschemicals”)shallfulfilltheirresponsibilitiesaccordingtothefollowing:(1)Theadministrativedepartmentinchargeofsafetyproductionandsupervisionwillberesponsibleforoverallworkforadministrationandsupervisionofsafetyofdangerouschemicals,organizethedetermination,publishing,adjustmentofthecatalogueofdangerouschemicals,examinethesafetyconditionsofconstructionprojectsfornewestablished,reconstructed,expan
