ContractRegistrationNo.:_________合同登记号:SUPERVISIONCONTRACTFORCONSTRUCTIONPROJECT建设工程委托监理合同ProjectName:工程项目名称:Entrustor(Client):委托方:(业主)Serviceprovider:(Supervisor)服务方:(监理人)Placeofsigning:ShangHai,P.R.China签订地点:中国，上海Dateofsigning:签订时间:2010年月日Validperiod:有效日期:SupervisionContractforConstructionProject建设工程委托监理合同PartIAgreement第一部分建设工程委托监理合同ThisAgreementissignedbetween(hereinafterreferredtoastheClient)and(hereinafterreferredtoastheSupervisor)throughmutualconsultation.委托人与监理人经过双方协商一致,签订本合同.I.BriefinformationoftheprojectforwhichtheClientdesiresthosesupervisionservicesshouldbeperformedbytheSupervisor(hereinafterreferredtoastheProject)isasfollows:委托人委托监理人监理的工程(以下简称本工程)概况如下:ProjectName:工程名称:ProjectLocation:工程地点:ProjectSize:m2工程规模:m2TotalInvestment:aboutyuanRmb总投资:约万元人民币II.InthisAgreementwordsshallhavethesamemeaningsasareassignedtotheminPartIIofthisSupervisionContract(hereinafterreferredtoas“theContract”)-StandardConditions.本合同的有关词语含义与本合同第二部分标准条件中赋予它们的定义相同.III.ThefollowingdocumentsshallbedeemedtoformpartofthisAgreement:下列文件均为本合同的组成部分:(1)ThisAgreement;此协议书;(2)StandardConditionsoftheContract;本合同标准条件;（条款）(3)ConditionsofParticularApplication;本合同专用条件;（条款）(4)SupplementarydocumentsandamendmentsjointlysignedbythetwopartiesduringtheexecutionoftheContract.在实施过程中双方共同签署的补充与修正文件.⑸监理人在报价时确定的的拟派现场监理人员名单和现场监理人员进场计划作为本合同附件。IV.InconsiderationofthepaymenttobemadebytheClienttotheSupervisorashereinaftermentioned,theSupervisorherebycovenantswiththeClienttoperformsupervisionservicesinthescopeasstatedintheConditionsofParticularApplicationinconformitywiththeprovisionsoftheContract.考虑到以下提到的委托人向监理人的付款，监理人向委托人承诺,按照本合同的规定,承担本合同专用条件中议定范围内的监理业务.V.TheClientherebycovenantstopaytheSupervisor,inconsiderationoftheperformanceofthesupervisionservices,suchamountasmaybecomepayableundertheprovisionsoftheContractatthetimesandinthemannerandcurrencytypeprescribedbytheContract.考虑到监理人提供的监理服务，委托人向监理人承诺按照本合同注明的期限,方式,币种,向监理人支付报酬.InwitnesswhereofthepartiesheretohavecausedthisAgreementtobeexecutedfromApril,2007toOctober,2008.Ifforanyreasonstheprojectstopsformorethanonemonthuninterrupted,theendingdatewillbepostponedwithsameperiods.本合同自施工单位进场时开始,至整个工程竣工验收止完成.如果项目进行中，被停止连续时间超过一个月，完成时间应该被顺延。ThisAgreementhassixsetsoforiginalcopies,theyhavethesamelegaleffect,andeachpartyshallholdthreecopies.本合同一式陆份,具有同等法律效力,双方各执叁份.TheClient:委托人:(seal)(签章))TheSupervisor:.监理人:(seal)(签章)Address:住所:Address:住所:LegalRepresentative:(signature)法定代表人:(签章)LegalRepresentative:(signature)法定代表人:(签章)Principalbank:开户银行:Principalbank:开户银行:Bankaccountno.:帐号:Bankaccountno.:帐号:324214234234234Tel.:电话:Tel.:1电话:Thiscontractissignedon,2010本合同签订于:2010年月日PartIIStandardConditions第二部分标准条件Definitions,ApplicableLanguagesandLaws词语定义,适用语言和法规Article1Thefollowingwordsandexpressionsshallhavethemeaningsassignedtothemexceptwherethecontextotherwiserequires:第一条下列名词和用语，除上下文另有规定外，具有如下所赋予的含义:(1)Projectmeanstheprojectforwhichthesupervisionservicesaretobeprovided.工程是指实施委托人委托监理人监理的工程。(2)ClientmeansthepartywhoisresponsibleforthedirectinvestmentandwhoemploystheSupervisor,andlegalsuccessorstotheClient.委托人是指承担直接投资责任和委托监理人的一方,以及其合法继承人。(3)SupervisormeansthepartywhoisemployedbytheClienttoperformsupervisionservicesandassumesupervisionliabilities,andlegalsuccessorstotheSupervisor.监理人是指受委托人委托承担监理业务和监理责任的一方,以及其合法继承人.(4)SupervisionTeammeansthegroupofstaffsentbytheSupervisortocarryoutsupervisiononthesiteoftheProject.监理机构是指监理人派驻本工程现场实施监理业务的组织.(5)ChiefSupervisionEngineermeansthepersoncertificatedbythelocalauthorityasChiefSupervisionEngineeranddesignatedbytheClientandSupervisortobefullyresponsibleforsupervisingtheexecutionoftheContract.总监理工程师是指经当地政府部门认证为的总监理工程师并且由委托人及监理人指定对监督履行本合同全权负责的人.(6)Contractormeanstheperson(s)otherthantheSupervisorwithwhomtheClientsignscontractinrelationtotheconstructionoftheProject.承包人是指除监理人以外,委托人就本工程的建设有关事宜签订合同的当事人.(7)NormalServicesmeansthescopeofsupervisionworkprescribedintheConditionsofParticularApplication.正常工作是指双方在专用条件中约定的监理工作的范围.(8)AdditionalServicesmeans:1)worksoutsideofthescopeofsupervisionwork,andaddedtotheContractbywrittenagreementoftheparties;2)additionalworksasaresultofadditiontothescopeofconstructionworkorprogramdelayonthepartoftheClientortheContractor.附加工作是指:1)监理工作范围以外,通过双方书面协议另外增如本合同的工作;2)建设工作范围的增加或者由于委托人或承包人原因致使进度的延误,而造成的附加的工作.(9)ExceptionalServicesmeanstheworksotherthantheNormalServicesandtheAdditionalServices,butwhicharenecessarilyperformedbytheSupervisorinaccordancewithArticle33.额外工作是指正常工作和附加工作以外，根据第三十三条规定监理人需要完成的工作。(10)daymeanstheperiodbetweenanyone0:00a.m.andthenext.日是指任何一个零时至第二天零时的时间段.(11)monthmeansaperiodofonemonthaccordingtotheGregorianCalendarcommencingwithanydayofthemonth.月是指根据公历从一个月份中任何一天开始的一个月的时间段.Article2ThisSupervisionContractshallbegovernedbyChineselaws,statutes,administrativeregulations,anddepartmentalrules®ulations,locallaws,rules®ulationsspecifiedintheStandardConditionsandConditionsofParticularApplication.第二条本建设工程委托监理合同适用的法律是中国的法律，条例,行政法规，以及标准条件及专用条件中载明的部门规章或地方法规，地方规章。Article3TheContractshallbewritteninbothEnglishandChinese,bothofwhichshallbeequallybinding.第三条本合同应以中文和英文记载，中英文应具有同等效力
