1CurrentLocation:AQSIQPolicyReleaseAQSIQOrders&AnnouncementsAQSIQOrders20092009“RegulationsGoverningtheInspection,QuarantineandSupervisionofImportedSolidScrapUsableasRawMaterials”(AQSIQOrderNo.119)08/21/2009No.119The“RegulationsGoverningtheInspection,QuarantineandSupervisionofImportedSolidScrapUsableasRawMaterials”,uponexaminationandadoptionattheexecutivemeetingoftheGeneralAdministrationofQualitySupervision,InspectionandQuarantine(“AQSIQ”)ofthePeople'sRepublicofChinaonMay26,2009,areherebypromulgatedandwilltakeeffectasfromNovember1,2009.MinisterAugust21,2009RegulationsGoverningtheInspection,QuarantineandSupervisionofImportedSolidScrapUsableasRawMaterialsCHAPTERI:GENERALPROVISIONSArticle1:Fortheexpresspurposeofimposingmorerigorouscontrolontheinspection,quarantineandsupervisionofimportedsolidscrapusableasrawmaterialsandachieveenvironmentalprotection,the“RegulationsGoverningtheInspection,QuarantineandSupervisionofImportedSolidScrapUsableasRawMaterials”(“TheRegulations”)havebeenenactedpursuanttorelatedprovisionsofthe“LawofthePeople’sRepublicofChinaforImportandExportCommodityInspection”andtheimplementationrulesthereof,“LawofthePeople’sRepublicofChinaforBorderHealthandQuarantine”andtheimplementationrulesthereof,“LawofthePeople'sRepublicofChinaforQuarantineonAnimal&PlantEntryandExit”andtheimplementationrulesthereof,and“LawofthePeople’sRepublicofChinaforthePreventionandControlofSolidWastePollution”andtheimplementationrulesthereof.Article2:TheRegulationsapplytotheinspection,quarantineandsupervisionofimportedsolidscrap(“scrap”)usableasrawmaterials.Article3:TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineofthePeople'sRepublicofChina(“AQSIQ”)isinchargeoftheinspection,quarantineandsupervisionofChina’simportedscrap.Entry-exitinspectionandquarantineauthorities(“InspectionandQuarantineAuthorities”)establishedbyAQSIQineachrespectivepartofChinaareinchargeoftheinspection,quarantineandsupervisionofChina’simportedscrapintheregionunderitsrespectivejurisdiction.Article4:TheStateshalladoptaregistrationsystemonoverseassuppliersanddomesticconsigneesofimportedscrap.Overseassuppliersanddomesticconsigneesshall,priortotradingagreementsigning,obtainregistration.2Article5:TheStateshalladoptapre-shipmentinspectionsystemonimportedscrap.Whenfilinganapplicationforimportedscrapinspection,aconsigneeshallprovideapre-shipmentinspectioncertificateissuedbyinspectionandquarantineauthoritiesoraninspectionagencydesignatedbyAQSIQ.Uponarrivalofimportedscrap,therespectiveinspectionandquarantineauthoritiesshallimplementinspectionandquarantineinaccordancewithrelatedlawandregulations.Article6:AQSIQshallimplementariskanalysis&early-warningreportingsystemonimportedscrapinspectionandquarantine.CHAPTERIIOVERSEASSUPPLIERREGISTRATIONArticle7:AQSIQisinchargeoftheacceptance,examinationandapprovalofoverseassupplierregistrationapplications.Article8:Anoverseassuppliershallcomplywiththefollowingrequirementsforfilinganapplicationforoverseassupplierregistration:(1)Possesslegalbusinessmanagementqualificationsinthecountry(orregion)inwhichtheoverseassupplierislocated;(2)Possessingaregularofficesite;(3)FamiliarizewithandcomplywithChina’slaw,rulesandregulationsconcerninginspectionquarantineandenvironmentalprotection;(4)AccreditedbyISO9001QualityManagementSystem(QMS)andRecyclingIndustryOperatingStandard(RIOS);(5)TheoverseassuppliershallensurethatitsproductscomplywiththemandatoryrequirementsofChina’snationaltechnicalspecificationsconcerningsafety,healthandenvironmentalprotectioncorrespondingtothoseforthecategoryofscrapfiledforregistration:(6)Possessrelativelystablescrapsupplyandadoptenvironmentalqualitycontrolmeasuresonthesourceofscrapedsupplied;(7)Absenceofmajorsafety,healthandenvironmentalqualityissuesinthepast3years;(8)Becapableoffilinganapplicationforregistrationandpre-shipmentinspectionovertheInternet,possessradioactivitydetectionequipmentandcorrespondinginfrastructure,andbecapableofdetectingradioactivity;Article9:Anoverseassuppliershallprovidethefollowinginformationwhenfilinganapplicationforregistration:(1)ARegistrationApplicationForm;(2)Notarizedtaxregistrationdocument(s)andanotarizedbusinessregistrationdocumentifabusinessregistrationdocumentisavailable;3(3)Adescriptionoftheorganizationanddepartmentsaswellasjobdutiesthereof;(4)Adimensionalfloorplanoftheregularofficesite,afloorplanofprocessingsite(s)ifaprocessingsiteisavailable,videofilesormorethan3photographswhichcanfullycapturetherealsceneoftheabovesite;(5)ColorphotocopiesofAccreditedbyISO9001QualityManagementSystem(QMS)andRecyclingIndustryOperatingStandard(RIOS)accreditationcertificatesandrelatedwrittenoperatingguidelines;WrittenmaterialssubmittedshouldbeinChineseorbothinChineseandEnglish.Article10:AQSIQshallprocessregistrationapplicationsfiledbyoverseassuppliersonacase-by-casebasisinaccordancewiththefollowingconditions:(1)Incaseofincompleteapplicationmaterialsornon-conformitywithlegalformalities,theapplicantconcernedshallbenotifiedofalladditionsorcorrectionstobemadeatonetimeonthespotorwithinfive
