1IMPLEMENTINGREGULATIONSOFTHEPATENTLAWOFTHEPEOPLE'SREPUBLICOFCHINA(PromulgatedbyDecreeNo.306oftheStateCouncilofthePeople'sRepublicofChinaonJune15,2001,amendedthefirsttimeonDecember28,2002accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina,andamendedthesecondtimeonJanuary9,2010accordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina)TranslatedbytheStateIntellectualPropertyofficeofthePeople'sRepublicofChina.Incaseofdiscrepancy,theoriginalversioninChineseshallprevail.ChapterIGeneralProvisionsRule1.TheseImplementingRegulationsareformulatedinaccordancewiththePatentLawofthePeople'sRepublicofChina(hereinafterreferredtoasthePatentLaw).Rule2.AnyformalitiesprescribedbythePatentLawandtheseImplementingRegulationsshallbecompliedwithinawrittenformorinanyotherformprescribedbythepatentadministrationdepartmentundertheStateCouncil.Rule3.AnydocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsshallbeinChinese;thestandardscientificandtechnicaltermsshallbeusedifthereisaprescribedonesetforthbytheState;wherenogenerallyacceptedtranslationinChinesecanbefoundforaforeignnameorscientificortechnicalterm,theoneintheoriginallanguageshallbealsoindicated.WhereanycertificateorcertifyingdocumentsubmittedinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulationsisinaforeignlanguage,thepatentadministrationdepartmentundertheStateCouncilmay,whenitdeemsnecessary,requestaChinesetranslationofthecertificateorthecertifyingdocumentbesubmittedwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertifyingdocumentshallbedeemednottohavebeensubmitted.Rule4.WhereanydocumentissentbymailtothepatentadministrationdepartmentundertheStateCouncil,thedateofmailingindicatedbythepostmarkontheenvelopeshallbedeemedtobethedateoffiling;wherethedateofmailingindicatedbythepostmarkontheenvelopeisillegible,thedateonwhichthepatentadministrationdepartmentundertheStateCouncilreceivesthedocumentshallbethedateoffiling,exceptwherethedateofmailingisprovedbythepartyconcerned.AnydocumentofthepatentadministrationdepartmentundertheStateCouncilmaybeservedbymail,bypersonaldeliveryorbyotherforms.Whereanypartyconcernedappointsapatentagency,thedocumentshallbesenttothepatentagency;wherenopatentagencyisappointed,thedocumentshallbesenttothecontactingpersonnamedintherequest.WhereanydocumentissentbymailbythepatentadministrationdepartmentundertheStateCouncil,the16thdayfromthedateofmailingshallbepresumedtobethedateonwhichthepartyconcernedreceivesthedocument.Whereanydocumentisdeliveredpersonallyinaccordancewiththeprovisionsofthepatentadministration2departmentundertheStateCouncil,thedateofdeliveryisthedateonwhichthepartyconcernedreceivesthedocument.Wheretheaddressofanydocumentisnotclearanditcannotbesentbymail,thedocumentmaybeservedbymakinganannouncement.Attheexpirationofonemonthfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.Rule5.ThefirstdayofanytimelimitprescribedinthePatentLawandtheseImplementingRegulationsshallnotbecountedinthetimelimit.Wherethetimelimitiscountedbyyearorbymonth,itshallexpireonthecorrespondingdayofthelastmonth;ifthereisnocorrespondingdayinthatmonth,thetimelimitshallexpireonthelastdayofthatmonth;ifatimelimitexpiresonanofficialholiday,itshallexpireonthefirstworkingdayfollowingthatofficialholiday.Rule6.WhereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofforcemajeure,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateonwhichtheimpedimentisremoved,atthelatestwithintwoyearsimmediatelyfollowingtheexpirationofthattimelimitrequestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.Exceptforcircumstancesprescribedinprecedingparagraph,whereatimelimitprescribedinthePatentLawortheseImplementingRegulationsorspecifiedbythepatentadministrationdepartmentundertheStateCouncilisnotobservedbyapartyconcernedbecauseofanyotherjustifiedreason,resultinginlossofhisoritsrights,heoritmay,withintwomonthsfromthedateofreceiptofanotificationfromthepatentadministrationdepartmentundertheStateCouncil,requestthepatentadministrationdepartmentundertheStateCounciltorestorehisoritsrights.WhereanypartyconcernedrequeststorestorehisoritsrightaccordingtoparagraphoneorparagraphtwoofthisRule,heoritshallsubmitarequestforrestorationofhisoritsright,statingthereasons,attaching,ifnecessary,therelevantcertifyingdocuments,andgothroughtherelevantformalitieswhichshouldhavebeencompliedwithbeforethelossofhisoritsright.WherethepartyconcernedrequestsforrestorationofhisoritsrightaccordingtoparagraphtwoofthisRule,heoritshallpaythefeeforrequestforrestorationofright.WherethepartyconcernedmakesarequestforanextensionofatimelimitspecifiedbythepatentadministrationdepartmentundertheStateCouncil,heoritshall,beforethetimelimitexpires,state
