(Xinhua)FoodSafetyLawofthePeople’sRepublicofChina(Adoptedatthe7thSessionofthe11thStandingCommitteeoftheNationalPeople’sCongressofthePeople’sRepublicofChinaonFebruary28,2009andrevisedatthe14thSessionofthe12thStandingCommitteeoftheNationalPeople’sCongressofthePeople’sRepublicofChinaonApril24,2015)TableofContentChapter1:GeneralPrinciplesChapter2:FoodSafetyRiskSurveillanceandAssessmentChapter3:FoodSafetyStandardsChapter4:FoodProductionandTradingSection1:GeneralProvisionsSection2:ProcessControlofProductionandTradingSection3:Label,ProductDescriptionandAdvertisementSection4:SpecialFoodsChapter5:FoodTestingChapter6:FoodImportandExportChapter7:HandlingofFoodSafetyIncidentsChapter8SupervisionandAdministrationChapter9:LegalLiabilitiesChapter10:SupplementaryProvisionsChapter1:GeneralPrinciplesArticle1ThisLawisformulatedtoassurefoodsafetyandsafeguardpeople’shealthandlife.Article2ThefollowingbusinessactivitiescarriedoutwithintheterritoryofthePeople’sRepublicofChinashallabidebythisLaw:1)Foodproductionandprocessing(hereinafterreferredtoas“foodproduction”);foodsalesandcateringservice(hereinafterreferredtoas“trading”);2)Productionandtradingoffoodadditives;)Productionandtradingofpackingmaterials,containers,detergents/disinfectantsforfoods,aswellastoolsandequipmentusedinfoodproductionandtrading(hereafterreferredtoas“food-relatedproducts”);4)Foodadditivesandfood-relatedproductsusedbyfoodproducersandtraders;5)Foodstorageandtransportation;6)Safetymanagementoffood,foodadditivesandfood-relatedproducts.Thequalityandsafetymanagementofprimaryagriculturalproductsforconsumption(hereinafterreferredtoas“edibleagriculturalproducts”)shallabidebytheLawofthePeople’sRepublicofChinaonQualityandSafetyofAgriculturalProducts.However,themarketingandsalesofedibleagriculturalproducts,developmentofrelevantqualitysafetystandardsandpublishingofrelevantsafetyinformationaswellasthequalityandsafetymanagementofagriculturalinputscoveredbythisLawshallabidebythisLaw.Article3Foodsafetyworkshallfollowtheprinciplesof“puttingpreventionfirst,risk-basedmanagement,whole-processcontrol,andmakingeffortsbythewholesociety”,aimingtoestablishthescientificandstrictsupervisionandadministrationsystem.Article4Foodproducersandtradersshalltakeresponsibilitiesforfoodproducedandtraded.Foodproducersandtradersshallfollowlaws,regulationsandfoodsafetystandardsintheiroperation.Theyarerequiredtoensurethefoodsafety,behonestandself-disciplined,beresponsibleforthesocietyandthepublic,acceptsupervisionandadministrationbethepublic,andbearthesocialresponsibilities.Article5TheStateCouncilestablishestheFoodSafetyCommittee,andassignsresponsibilitiestotheCommittee.TheChinaFoodandDrugAdministration(CFDA)undertheStateCouncil,inaccordancewiththisLawandtheresponsibilitiesidentifiedbytheStateCouncil,supervisionandadministrationsfoodproductionandtradingactivities.TheStateCouncilhealthadministrativedepartment(theNationalHealthandFamilyPlanningCommission,NHFPC),inaccordancewiththisLawandtheresponsibilitiesidentifiedbytheStateCouncil,conductsfoodsafetyrisksurveillance,riskassessment,anddevelopsandpublishesnationalfoodsafetystandardsjointlywiththeCFDA.OtherministriesundertheStateCouncilshallundertakerelevantfoodsafetyworkinaccordancewiththisLawandresponsibilitiesidentifiedbytheStateCouncil.Article6Countyandabovelevelgovernmentsshallberesponsibleforthefoodsafetysupervisionandmanagementintheregion;itshalllead,organizeandcoordinatefoodsafetysupervisionandadministrationwork,aswellasrespondtofoodsafetyincidents,establish/improvethewholeprocessfoodsafetymanagementmechanismandtheinformationsharingmechanism.Countyandabovelevelgovernments,inaccordancewiththisLawandprovisionsoftheStateCouncil,determinestheresponsibilitiesofthefoodanddrugadministration,thehealthadministrativedepartmentandotherrelevantdepartmentsofthesamelevels;relevantdepartmentsshallberesponsibleforfoodsafetysupervisionandadministrationaccordingly.Thecounty-levelfoodanddrugadministrationcouldestablishresidentagenciesintownsorcertaindistricts.
