’sRepublicofChinaPromulgationDate:26thJanuary2002EffectiveDate:15thMarch2002Promulgatedby:TheStateCouncilChapterIGeneralPrinciplesArticle1Inordertostrengthenthecontroloversafetyofdangerouschemicals,toguaranteethepeople’slifeandpropertysafety,andtoprotecttheenvironment,theseRegulationsareherebyenacted.Article2Production,operation,storage,transportation,anduseofdangerouschemicalsanddisposalofthewasteddangerouschemicalswithintheterritoryofthePeople’sRepublicofChinashallbegovernedbytheseRegulations,lawsandotheradministrativeregulationsoftheStateonproductionsafety.Article3“Dangerouschemicals”asreferredtohereinincludeexplosives,pressuregas,liquefiedgas,inflammableliquid,inflammablesolid,spontaneouscombustiblearticles,combustiblematerialsincaseofmoisture,oxidants,organicperoxide,toxicarticles,corrosives,etc.DangerouschemicalslistedontotheListofDangerousArticles(GB12268)promulgatedasthenationalstandard,thecatalogueofhyper-toxicchemicals,andotherdangerouschemicalsnotlistedontotheListofDangerousArticlesshallbedeterminedandannouncedbytheadministrativedepartmentinchargeofcomprehensivemanagementofeconomyandtradejointlywiththeadministrativedepartmentsinchargeofpublicsecurity,environmentalprotection,health,qualitycontrol,trafficcontrol,etcoftheStateCouncil.Article4Thepersonnelchieflyinchargeofunitsthatmanufacture,dealin,store,transport,andusethedangerouschemicalsanddisposeofthewasteddangerouschemicals(hereinafterreferredtoasthe“unitsofdangerouschemicals”)mustguaranteethesafetycontrolfortheirowndangerous:(1)TheadministrativedepartmentinchargeofoverallmanagementofeconomyandtradeoftheStateCouncilandtheadministrativedepartmentsofeconomyandtradeofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralPeople’sGovernmentshall,inaccordancewiththeseRegulations,beresponsiblefortheoverallworkforthesupervisionandadministrationofsafetyofdangerouschemicals,beresponsibleforexaminationandapprovaloftheestablishment,reconstruction,andexpansionofenterprisesthatmanufactureorstoredangerouschemicals,beresponsiblefortheexaminationandappointmentoftheprofessionalmanufacturingenterprisesofpackingmaterialsorcontainers(includingtroughcontainersusedfortransportation,hereinafterinclusive),beresponsibleforissuanceofthelicensesforoperationofdangerouschemicals,beresponsibleforregistrationofdomesticdangerouschemicals,beresponsiblefororganizingandcoordinatingtheemergencyrescueforthedangerouschemicalaccidents,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.Theadministrativedepartmentinchargeoftheoverallworkforsupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsofmunicipalities(withdistricts)andthepeople’sgovernmentsatthecountylevelshallbedeterminedbythepeople’sgovernmentsatalllevels,andfulfilltheir(2)Thepublicsecurityorgansshallberesponsibleforthepublicsecuritycontroloverdangerouschemicals,beresponsiblefortheissuanceofhyper-toxicchemicalpurchasecredenceandpurchaselicenses,beresponsibleforexamining,approving,andissuingroadtransportationpassesforhyper-toxicchemicals,beresponsibleforsupervisionoverthesafetyoftheroadtransportationofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(3)Theadministrativedepartmentsinchargeofqualitycontrolshallberesponsiblefortheissuanceofthemanufacturelicensesfordangerouschemicalsandtheirpackingmaterialsaswellascontainers,beresponsibleforthesupervisionoverthequalityofpackingmaterialsandcontainersofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(4)Theadministrativedepartmentsinchargeofenvironmentalprotectionshallberesponsibleforthesupervisionandadministrationofthedisposalofwasteddangerouschemicals,beresponsiblefortheinvestigationofseriousdangerouschemicalpollutionaccidentsandtheecologicaldamageincidents,beresponsiblefortheemergencymonitoringofthesitesoftoxicchemicalaccidentsandregistrationoftheimporteddangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.(5)Theadministrativedepa
