·1·LawofthePeople'sRepublicofChinaonthePreventionandControlofOccupationalDiseases(Adoptedatthe24thsessionoftheStandingCommitteeoftheNinthNationalPeople'sCongressonOctober27,2001;andamendedaccordingtotheDecisiononAmendingtheLawofthePeople'sRepublicofChinaonthePreventionandControlofOccupationalDiseasesasadoptedatthe24thsessionoftheStandingCommitteeoftheEleventhNationalPeople'sCongressonDecember31,2011)ContentsChapterIGeneralProvisionsChapterIIEarlyPreventionChapterIIIProtectionandManagementduringEmploymentChapterIVOccupationalDiseaseDiagnosisandSafeguardsforOccupationalDiseasePatientsChapterVSupervisionandInspectionChapterVILegalLiabilityChapterVIISupplementaryProvisionsChapterIGeneralProvisionsArticle1Toprevent,control,andeliminateoccupationaldiseasehazards,preventandcontroloccupationaldiseases,protectthehealthandrelevantrightsandinterestsofemployees,andpromoteeconomicandsocialdevelopment,thisLawisformulatedinaccordancewiththeConstitution.Article2ThislawshallapplytothepreventionandcontrolofoccupationaldiseaseswithintheterritoryofthePeople'sRepublicofChina.ForthepurposesofthisLaw,“occupationaldiseases”meansthediseasescontractedbytheemployeesofanenterprise,apublicinstitution,anindividualeconomicorganization,orotheremployerfortheirexposurestotoxicorharmfulfactorssuchasdustandradioactivesubstancesinoccupationalactivities.Thecategoriesandcatalogueofoccupationaldiseasesshallbedetermined,adjusted,andpublishedbythehealthadministrativedepartmentoftheStateCouncilinconjunctionwiththeworksafetyadministrativedepartmentandlaborandsocialsecurityadministrativedepartmentoftheStateCouncil.Article3Inthepreventionandcontrolofoccupationaldiseases,theguidelineof“focusingonpreventionandcombiningpreventionwithcontrol”shallbefollowed,amechanismof“responsibilityoftheemployers,regulationbytheadministrativeorgans,industryselfdiscipline,participationbytheemployees,andsupervisionbythegeneralpublic”shallbeestablished,andcategorizedmanagementandcomprehensivecontrolshallbeimplemented.Article4Employeesshallbeentitledtooccupationalhealthprotectionaccordingtolaw.Employersshallcreateworkenvironmentandconditionsmeetingthenationaloccupationalhealthstandardsandhealthrequirementsandtakemeasurestoensurethatemployeesreceiveoccupationalhealthprotection.Tradeunionsshalloverseethepreventionandcontrolofoccupationaldiseasesandprotectthelawfulrightsandinterestsofemployeesaccordingtolaw.Whenformulatingoramendingrulesandregulationsonthepreventionandcontrolofoccupationaldiseases,employersshallsolicittheopinionsoftradeunions.Article5Employersshallestablishandimprovearesponsibilitysystemforthepreventionandcontrolofoccupationaldiseases,strengthenthemanagementofpreventionandcontrolofoccupationaldiseases,improvetheircapabilitiesofpreventionandcontrolofoccupationaldiseases,andassumeresponsibilitiesfortheirownoccupationaldiseasehazards.Article6Theprimarypersoninchargeofanemployershallassumetheoverallresponsibilityfortheemployer'spreventionandcontrolofoccupationaldiseases.Article7Employersmustparticipateinworkrelatedinjuryinsuranceaccordingtolaw.ThelaborandsocialsecurityadministrativedepartmentsoftheStateCouncilandthelocalpeople'sgovernmentsatandabovethecountylevelshallstrengthentheirsupervisionandadministrationofworkrelatedinjuryinsuranceandensurethatemployeesenjoythebenefitsofworkrelatedinjuryinsuranceaccordingtolaw.Article8Thestateencouragesandsupportstheresearch,development,promotion,andapplicationofnewtechnologies,newprocesses,newequipment,andnewmaterialswhichfacilitatethepreventionandcontrolofoccupationaldiseasesandthehealthprotectionofemployeesandaccentuatesthefundamentalresearchonthemechanismsandoccurrencepatternsofoccupationaldiseasestoelevatethescientificandtechnologicallevelsinthepreventionandcontrolofoccupationaldiseases;technologies,processes,equipment,andmaterialswhichareeffectiveforthepreventionandcontrolofoccupationaldiseasesshallbeactivelyadopted;andtechnologies,processes,equipment,andmaterialswhichcauseseriousoccupationaldiseasehazardsshallberestrictedinuseoreliminated.Thestateencouragesandsupportstheconstructionofmedicalrehabilitationinstitutionsforoccupationaldiseases.Article9Thestateshallapplyanoccupationalhealthsupervisionsystem.Theworksafetyadministrativedepartment,healthadministrativedepartment,andlaborandsocialsecurityadministrativedepartmentoftheStateCouncilshall,accordingtothefunctionsprescribedbythisLawandtheStateCouncil,superviseandadministerthepreventionandcontrolofoccupationaldiseasesacrossthecountry.OtherrelevantdepartmentsoftheStateCouncilshall,withintheirrespectivefunctions,superviseandadministerthepreventionandcontrolofoccupationaldiseases.Theworksafetyadministrativedepartments,healthadministrativedepartments,andlaborandsocialsecurityadministrativedepartmentsofthelocalpeople'sgovernmentsatandabovethecountylevelshall,accordingtotheirrespectivefunctions,superviseandadministerthepreventionandcontrolofoccupationaldiseaseswithintheirrespectiveadministrativeregions.Otherrelevantdepartmentsofthelocalpeople'sgovernmentsatandabovethecountyle
