LABORCONTRACTOFSHENZHENPartyA(theEmployer)PartyB(theEmployee)Name:Name:AddressSex:LegalRepresentative:IDNo.:Address:Contactperson:Telephone:Telephone：InaccordancewiththeLaborContractLawofthePeople’sRepublicofChina(hereinafterreferredtoas“theLaborContractLaw”)andotherapplicablelawsandregulations,andbasedontheprinciplesofequality,freewill,goodfaith,compliancewithlawandmutualnegotiation,PartyAandPartyBherebyenterintothisContractandagreetojointlyabidebythetermsandconditionscontainedherein.Article1ContractTerm1.1BothPartiesagreetodeterminethetermofthisContractby____ofthefollowingmethods:1.1.1Fixedterm:from_____to_____.1.1.2Unfixedterm:：。1.1.3Completionofcertainworkastheterm:from_____tocompletionof_____work.Thestandardoncompletionoftheworkshallbe_____.1.2Theprobationperiodshallbenone(theprobationperiodshallbeincludedinthetermofthisContract.Incaseofnoprobationperiod,fill“none”intheblank).Article2ContentsofWorkThePartyBshallactas(positionortypeofwork)salesengineer,whoshallberesponsibleforsaleofprintingequipmentoftheplasticpackingdepartmentofPartyAandotherworkinChina,andshallreporttotherelevantresponsiblepersonsofSwissHeadquartersandThailandBranchCompany.Article3WorkingTime3.1StandardworkingtimesystemshallbeadoptedforPartyB,thatis,PartBshallwork8hoursperdayand5daysperweek,withoutadditionalremunerationforovertimework.3.2AnyextensionofworktimeasrequiredbyPartyA’sproductionandoperationshallbegovernedbyArticle41oftheLaborLaw.Article4SalaryandTreatment4.1PartyAshallformulatethesalarysystemaccordingtolawandnotifyPartyBthereof.ThesalarypaidbyPartyAtoPartyBshallnotbelowerthantheminimumsalaryissuedbythelocalmunicipalgovernmentinthatyear.4.2ThemonthlysalaryofPartyBshallbeRMB。4.3PartyAshallpaythesalarytoPartyBonthe30thdayofeachmonth.PartyAshallpaytoPartyBthesalaryatleastonceineachmonthbymeansofcurrency.4.4Theovertimesalary,salaryduringvacation,leaveandparticularcircumstancesshallbegovernedbytherelevantlawsandregulations,suchastheRegulationsofShenzhenRegardingPaymentofEmployee’sSalaries.4.5OtherprovisionsonsalaryasagreedbybothParties:withinthevalidtermofthisContract,performancebonusshallbedeterminedbasedonthenetsalepriceofequipment(i.e.,thepriceafterthefreightandtheexpensesforinstallationandcommissioningarededucted).Thecontractsforsaleofsparepartsandcomponentsandforinstallationshallnotbeincludedintheplanonperformancebonus.Article5LaborProtectionandLaborConditions5.1PartyAshall,inaccordancewiththerelevantprovisionsonlaborprotectionoftheState,providethelaborandoperationplacesandnecessarylaborprotectivearticlesinconformitywiththehealthstandardsoftheState,soastopracticablyensurethesafetyandhealthofPartyBintheproductionandwork.5.2PartyBwillbeengagedintheoperationof/thatmaycausetheprofessionaldangerof/,so,PartyAshalltaketheprotectivemeasuresof/andarrangePartyBformedicalcheck/timeeachyear.5.3PartyBshallhavetherighttorefusetooperateifPartyAcommandstheoperationinviolationofrulesandregulationsorforcesPartyBtorunrisksinoperation;PartyBshallhavetherighttorequirePartyAtorectifytheactsofPartyAendangeringthesafetyofhislifeandhealthorreportsuchcasetothecompetentdepartments.Article6SocialInsuranceandWelfare6.1PartyAshallhandletheproceduresforsocialinsuranceforPartyBaccordingtolaw,andthepaymentofsocialinsurancepremiumshallbegovernedbythelaws,regulationsandrulesregardingsocialinsurance.6.2IfPartyBissickorsuffersjob-unrelatedinjury,PartyAshallprovidethemedicaltreatmentperiodandmedicaltreatmentinaccordancewithrelevantprovisionsoftheState.6.3IfPartyBcontractsanoccupationaldisease,orsuffersjob-relatedinjuryordeath,PartyAshallhandlethecaseinaccordancewiththerelevantlawsandregulationssuchastheLawonPreventionfromandTreatmentofOccupationalDiseaseandtheRegulationsonJob-RelatedInsurance.6.4PartyBshallbeentitledtolegalholidays,annualvacation,marriageleave,maternityleaveandfuneralleave,etc.,accordingtolaw.Article7LaborDiscipline7.1TherulesandregulationsformulatedbyPartyAaccordingtolawshallbemadepublicandnotifiedtoPartyB.7.2PartyBshallconsciouslyabidebytherelevantlawsandregulationsatthelevelofState,provinceandcityandtherulesandregulationsformulatedbyPartyAaccordingtolaw,complywiththeoperationregulationsinsafety,besubjecttothemanagementoftheCompany,andcompletehisworkingtaskstimely.7.3PartyBshallconsciouslyabidebytheprovisionsonfamilyplanatthelevelofState,provinceandcity.Article8ChangeThisContractmaybechangeduponagreementreachedbybothPartiesthroughconsultation.AnychangeofthisContractshallbehandledinwriting.Article9Revocation9.1PriortoexpirationofthisContract,anyrevocationofthisContractbybothPartiesoreitherpartyinadvanceshallcomplywiththerelevantprovisionsofthelawsandregulations.9.2Iftheconditionsonpaymentofeconomiccompensationaremet,PartyAshallpaytoPartyBtheeconomiccompensationaccordingtolaw.9.3IfthisContractisrevokedbybothParties,PartyAshallprovideawrittencertificatetoPartyB,andtimelyhandletherelevantproceduresforrevocationofthisContract.Article10Termination10.1UponexpirationofthisContractorsatisfactionoftheconditionsonterminationofthisContractasagreedbybothPa
