中华人民共和国妇女权益保障法LawofthePeople'sRepublicofChinaontheProtectionofRightsandInterestsofWomen(AdoptedattheFifthSessionoftheSeventhNationalPeople'sCongressonApril3,1992andpromulgatedbyOrderNo.58ofthePresidentofthePeople'sRepublicofChinaonApril3,1992)时效性：已被修正颁布日期：19920403实施日期：19921001失效日期：20051201颁布单位：全国人大ContentsChapterIGeneralProvisionsChapterIIPoliticalRightsChapterIIIRightsandInterestsRelatingtoCultureandEducationChapterIVRightsandInterestsRelatingtoWorkChapterVRightsandInterestsRelatingtoPropertyChapterVIRightsRelatingtothePersonChapterVIIRightsandInterestsRelatingtoMarriageandFamilyChapterVIIILegalLiabilitiesChapterIXSupplementaryProvisionsChapterIGeneralProvisionsArticle1InaccordancewiththeConstitutionandtheactualconditionsofthecountry,thisLawisformulatedtoprotectwomen'slawfulrightsandinterests,promotetheequalitybetweenmenandwomenandallowfullplaytowomen'sroleinsocialistmodernization.Article2Womenshallenjoyequalrightswithmeninallaspectsofpolitical,economic,cultural,socialandfamilylife.TheStateshallprotectthespecialrightsandinterestsenjoyedbywomenaccordingtolaw,andgraduallyperfectitssocialsecuritysystemwithrespecttowomen.Discriminationagainst,maltreatmentof,orcrueltreatmentinanymannercausingbodilyinjurytoordeathofwomenshallbeprohibited.Article3Theprotectionofwomen'slawfulrightsandinterestsisacommonresponsibilityofthewholesociety.Stateorgans,publicorganizations,enterprisesandinstitutionsaswellasurbanandruralmassorganizationsofself-governmentatthegrass-rootslevelshall,inaccordancewiththeprovisionsofthisLawandotherrelevantlaws,protectwomen'srightsandinterests.TheStateshalltakeeffectivemeasurestoprovidenecessaryconditionsforwomentoexercisetheirrightsaccordingtolaw.Article4TheStateCouncilandthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshall,bytakingorganizationalmeasures,coordinatewithrelevantdepartmentsinensuringtheprotectionofwomen'srightsandinterests.ThespecificorgansshallbedesignatedbytheStateCouncilandthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment.Article5TheAll-ChinaWomen'sFederationandwomen'sfederationsatvariouslevelsshallrepresentandupholdtherightsofwomenofallnationalitiesandallwalksoflife,andstrivefortheprotectionofwomen'srightsandinterests.ThetradeunionsandtheCommunistYouthLeagueorganizationsshallalso,withinthescopeoftheirrespectivework,strivefortheprotectionofwomen'srightsandinterests.Article6TheStateshallencouragewomentocultivateasenseofself-respect,self-confidence,self-relianceandself-strengthening,andtosafeguardtheirownlawfulrightsandinterestsbyutilizinglaw.WomenshallabidebythelawsoftheState,respectsocialmoralityandperformtheirobligationsprescribedbylaw.Article7People'sgovernmentsatvariouslevelsandrelevantdepartmentsshallcommendandawardtheorganizationsandindividualsthathavemadenotableachievementsintheprotectionofwomen'slawfulrightsandinterests.ChapterIIPoliticalRightsArticle8TheStateshallguaranteethatwomenenjoyequalpoliticalrightswithmen.Article9WomenhavetherighttoconductStateaffairs,manageeconomicandculturalundertakingsandadministersocialaffairsthroughvariouschannelsandinvariousways.Article10Womenshallenjoytheequalright,withmen,tovoteandtostandforelection.AmongdeputiestotheNationalPeople'sCongressandlocalpeople'scongressesatvariouslevels,thereshallbeanappropriatenumberofwomendeputies,andtheproportionthereofshallberaisedgradually.Article11TheStateshallactivelytrainandselectfemalecadres.Stateorgans,publicorganizations,enterprisesandinstitutionsmust,inappointingcadres,adheretotheprincipleofequalitybetweenmenandwomen,andattachimportancetothetrainingandselectionoffemalecadresforleadingposts.TheStateshallpayattentiontothetrainingandselectionoffemalecadresofminoritynationalities.Article12Women'sfederationsatvariouslevelsandtheirmemberorganizationsmayrecommendfemalecadrestoStateorgans,publicorganizations,enterprisesorinstitutions.Article13Thedepartmentsconcernedshalllistentoandacceptcriticismsorrationalsuggestionsregardingtheprotectionofwomen'srightsandinterests;withrespecttocomplaintsorchargesagainst,orexposuresofinfringementuponwomen'srightsandinterests,thedepartmentsconcernedmustascertainthefacts,andberesponsiblefortheirdisposition;noorganizationorindividualmaysuppresssuchcomplaints,chargesorexposuresorresorttoretaliation.ChapterIIIRightsandInterestsRelatingtoCultureandEducationArticle14TheStateshallguaranteethatwomenenjoyequalrightswithmenwithrespecttocultureandeducation.Article15Schoolsanddepartmentsconcernedshall,byimplementingtherelevantregulationsoftheState,guaranteethatwomenenjoyequalrightswithmeninsuchaspectsasstartingschool,enteringahigherschool,jobassignmentupongraduation,confermentofacademicdegreesanddispatchforstudyabroad.Article16Schoolsshall,inlinewiththecharacteristicsoffemaleadolescents,takemeasuresinrespectofeducation,managementandfacilitiessoastoensurefemaleadolescents'sounddevelopmentinbodyandinmind.Article17Parentsorotherguardiansmustperformtheirdutyofensuringthatfemaleschool-a
