1MarineInsurance1.MARINEINSURANCEDEFINEDAcontractofmarineinsuranceisacontractwherebytheinsurerundertakestoindemnifytheassured,inmannerandtotheextenttherebybyagreed,againstmarinelosses,thatistosay,thelossesincidenttomarineadventure.2.MIXEDSEAANDLANDRISKS1.Acontractofmarineinsurancemay,byitsexpressterms,orbyusageoftrade,beextendedsoastoprotecttheassuredagainstlossesoninlandwatersoronanylandriskwhichmaybeincidentaltoanyseavoyage.2.Whereashipincourseofbuilding,orthelaunchofaship,oranyadventureanalogoustoamarineadventure,iscoveredbyapolicyintheformofamarinepolicy,theprovisionsofthisAct,insofarasapplicable,shallapplythereto;but,exceptasbythissectionprovided,nothinginthisActshallalteroraffectanyruleoflawapplicabletoanycontractofinsuranceotherthanacontractofmarineinsuranceasbythisActdefined.3.MARINEADVENTUREANDMARITIMEPERILSDEFINED1.SubjecttotheprovisionsofthisAct,everylawfulmarineadventuremaybethesubjectofacontractofmarineinsurance.2.Inparticularthereisamarineadventurewhere—a.Anyship,goodsorothermoveablesareexposedtomaritimeperils.SuchpropertyisinthisActreferredtoasinsurableproperty;b.Theearningoracquisitionofanyfreight,passagemoney,commission,profit,orotherpecuniarybenefit,orthesecurityforanyadvances,loan,ordisbursements,isendangeredbytheexposureofinsurablepropertytomaritimeperils;c.Anyliabilitytoathirdpartymaybeincurredbytheownerof,orotherpersoninterestedinorresponsiblefor,insurableproperty,byreasonofmaritimeperils.Maritimeperilsmeanstheperilsconsequenton,orincidentalto,thenavigationofthesea,thatistosay,perilsofthesea,fire,warperils,pirates,rovers,thieves,captures,seizures,restraints,anddetainmentsofprincesandpeoples,jettisons,barratry,andanyotherperils,eitherofthelikekindorwhichmaybedesignatedbythepolicy.InsurableInterest24.AVOIDANCEOFWAGERINGORGAMINGCONTRACTS1.Everycontractofmarineinsurancebywayofgamingorwageringisvoid.2.Acontractofmarineinsuranceisdeemedtobeagamingorwageringcontract—a.WheretheassuredhasnotaninsurableinterestasdefinedbythisAct,andthecontractisenteredintowithnoexpectationofacquiringsuchaninterest;orb.Wherethepolicyismadeinterestornointerest,orwithoutfurtherproofofinterestthanthepolicyitself,orwithoutbenefitofsalvagetotheinsurer,orsubjecttoanyotherliketermProvidedthat,wherethereisnopossibilityofsalvage,apolicymaybeeffectedwithoutbenefitofsalvagetotheinsurer.5.INSURABLEINTERESTDEFINED1.SubjecttotheprovisionsofthisAct,everypersonhasaninsurableinterestwhoisinterestedinamarineadventure.2.Inparticularapersonisinterestedinamarineadventurewherehestandsinanylegalorequitablerelationtotheadventureortoanyinsurablepropertyatrisktherein,inconsequenceofwhichhemaybenefitbythesafetyorduearrivalofinsurableproperty,ormaybeprejudicedbyitsloss,ordamagethereto,orbythedetentionthereof,ormayincurliabilityinrespectthereof.6.WHENINTERESTMUSTATTACH1.Theassuredmustbeinterestedinthesubject-matterinsuredatthetimeofthelossthoughheneednotbeinterestedwhentheinsuranceiseffected:Providedthatwherethesubject-matterisinsuredlostornotlost,theassuredmayrecoveralthoughhemaynothaveacquiredhisinterestuntilaftertheloss,unlessatthetimeofeffectingthecontractofinsurancetheassuredwasawareoftheloss,andtheinsurerwasnot.2.Wheretheassuredhasnointerestatthetimeoftheloss,hecannotacquireinterestbyanyactorelectionafterheisawareoftheloss.7.DEFEASIBLEORCONTINGENTINTEREST1.Adefeasibleinterestisinsurable,asalsoisacontingentinterest.2.Inparticular,wherethebuyerofgoodshasinsuredthem,hehasaninsurableinterest,notwithstandingthathemight,athiselection,haverejectedthegoods,orhavetreatedthemasattheseller’srisk,byreasonofthelatter’sdelayinmakingdeliveryorotherwise.38.PARTIALINTERESTApartialinterestofanynatureisinsurable.9.RE-INSURANCE1.Theinsurerunderacontractofmarineinsurancehasaninsurableinterestinhisrisk,andmayre-insureinrespectofit.2.Unlessthepolicyotherwiseprovides,theoriginalassuredhasnorightorinterestinrespectofsuchre-insurance.10.BOTTOMRYThelenderofmoneyonbottomryorrespondentiahasaninsurableinterestinrespectoftheloan.11.MASTER'SANDSEAMEN'SWAGESThemasteroranymemberofthecrewofashiphasaninsurableinterestinrespectofhiswages.12.ADVANCEFREIGHTInthecaseofadvancefreight,thepersonadvancingthefreighthasaninsurableinterest,insofarassuchfreightisnotrepayableincaseofloss.13.CHARGESOFINSURANCETheassuredhasaninsurableinterestinthechargesofanyinsurancewhichhemayeffect.14.QUANTUMOFINTEREST1.Wherethesubject-matterinsuredismortgaged,themortgagorhasaninsurableinterestinthefullvaluethereof,andthemortgageehasaninsurableinterestinrespectofanysumdueortobecomedueunderthemortgage.2.Amortgagee,consignee,orotherpersonhavinganinterestinthesubject-matterinsuredmayinsureonbehalfandforthebenefitofotherpersonsinterestedaswellasforhisownbenefit.3.Theownerofinsurablepropertyhasaninsurableinterestinrespectofthefullvaluethereof,notwithstandingthatsomethirdpersonmayhaveagreed,orbeliable,toindemnifyhimincaseofloss.15.ASSIGNMENTOFINTEREST4Wheretheassuredassignsorotherwisepartswithhisinterestinthesubject-matterinsured,hedoesnottherebytransfertotheassigneehisrightsunderthecontractofinsurance,unl
