购房款分期偿还协议书HousePaymentInstallmentAgreement开发商:新凯（沈阳）房地产开发有限公司（以下简称甲方）Developer:NewVictory(Shenyang)RealEstateDevelopmentLimitedCompany(hereinafterreferredtoasPartyA)购买方:（以下简称乙方）Buyer:(hereinafterreferredtoasPartyB)身份证/护照（营业执照）号码:IDcard/Passport(businesslicense)number:通讯地址:邮编:Address:Postcode:联系电话:1、2、ContactPhone:1、2、甲乙双方本着自愿、平等、诚实信用的原则，经友好协商，签订如下首付款分期付款协议：PartyAandPartyBintheprincipleofvoluntary,equality,honestyandcredibility,throughfriendlyconsultation,signedthefollowingHousePaymentInstallmentAgreement:一、乙方以分期支付购房款的方式于年月日购买了甲方的“逸景盛熙城”项目幢单元室，总房款为人民币佰拾万仟佰拾元。I.PartyBpurchasethepropertydevelopmentbyPartyAofthe“GrandShenyangInternationalCity”buildingunitroomwithinstallmentpaymentintheyear,monthday,thetotalpropertypurchasepriceisRMB.二、甲方同意乙方分三年分期向甲方支付购房首付款，即总房款的30%，乙方应于第四年正式签订《商品房买卖合同》前分期每期元支付购房首期款（含定金）即共：元，剩余购房款乙方可以现金或银行按揭贷款的方式，于正式交房年月日前还清，该款项还款至甲方的开户银行：，银行帐号：；II.PartyAagreesPartyBcanpaytheDownPaymenttoPartyAwithinstallment,DownPaymentmeans30%ofthetotalhousepurchaseprice,BeforeofficiallysigningtheCommodityhousingsalescontractPartyBshallpaidtheDownPayment(Includingdeposit)whichis:RMBintotal,withinstallmentandeachpaymentofRMBtothefollowingPartyA’sbankaccountincash,banktransferorremittance,theremaininghousepurchasepriceshallbepaybeforetheofficialhousehandoverwithcashormortgagebeforeyearmonthday:PartyA’sbankaccountnumber:三、乙方必须在规定的期限内还清全部购房首付款。III.PartyBmustpayalltheDownPaymentwithinthestipulatedtimelimit.四、如乙方未按协议规定的时间还款，自本协议规定的应还款期限之第二天起至实际全额付清之日止，甲方有权按应还未还金额的日千分之一向乙方收取违约金直至还清之日。IV.IfPartyBfailstopaytheDownPaymentatthestipulatedtimeofthisagreement,PartyAshallhavetherighttochargetheliquidateddamagestoPartyBforthe1/1000ofunpaidamountperday,fromtheseconddaysafterthestipulateddateofthisAgreementshallbepaiduntilpaidinfull.五、除非乙方未按本协议约定支付购房款，甲方不得将该房屋售于任何第三方。V.UnlessotherwisePartyBfailtopaythepaymentstipulatedinthisAgreement,PartyAshallnotsellthehousetoanythirdparty.六、甲、乙双方一致同意，乙方支付首付款金额以甲方收款银行收款记录或收款凭证为准。VI.PartyAandPartyBmutuallyagree,theinstallmentpaymentamountpaybyPartyBshallbeinaccordancewiththebankaccountrecordofthePartyAreceivingaccountorcertificateofreceipts.七、乙方在如未按本协议实际还清所有购房款前，甲方有权拒绝为乙方办理交房手续。乙方如逾期付款而产生违约金时，乙方应当连逾期支付的首付款违约金一并付清。VII.BeforePartyBtoactuallypaythetotalhousepurchasepriceaccordingtothisAgreement,PartyAshallhavetherighttorefusetoprocessthehandoverproceduretothePartyB.IfPartyBfailstomaketheinstallmentpaymentinduetimeandcauseliquidateddamages,PartyBshallpaytheoverduepaymentalongwiththeliquidateddamagesatonce.八、协议期内，乙方不得随意更变业主身份，不得退房、不得改变房屋结构和格局、不得出租房屋、不得设置他项权利，并不得单方面终止本协议及与本协议相关合同及补充协议。VIII.Duringthetermofthisagreement,PartyBshallnotchangetheidentityoftheowneratwill,shallnotcancelthepurchase,shallnotunilaterallyterminatethisAgreementandtherelatedcontractand/orsupplementaryagreementofthisAgreement.九、乙方若不能按期和足额的支付所有购房款，除违约金加收计取外，乙方不得要求甲方按期交付所购房屋，也不得要求甲方承担《商品房买卖合同》中约定的甲方逾期交房的一切违约责任。IX.IfPartyBfailstotimelyandfullpayingthetotalhousepurchasepricetoPartyA,besidethepenaltyshallbesurcharge,PartyBshallnotrequirePartyAtimelydeliveryofpurchasedhousing,alsoshallnotrequirePartyAtobearanyliabilityofoverduehandoverstipulatedintheCommodityhousingsalescontracts.十、乙方逾期支付超过30日的，除按本协议第四条约定支付违约金外，逾期超过90日时，视为乙方违反本协议并同意甲方单方解除协议，甲方有权解除协议，乙方已付首期款将被视为该房屋定金，甲方可依法罚没违约方之定金。X.PartyBfailtopaytheinstallmentmorethan30days,besidetopayliquidateddamagesinaccordancewithArticleIVofthisagreement,ifthedelaypaymentismorethan90days,PartyBshallbedeemasbreachofthisAgreementandunilaterallyterminatethisAgreement,PartyAhasrighttoterminatethisAgreement,allpaymentpaidbythePartyBshallbeconsiderasthesecuritydepositofthehousepurchasing,PartyAshallhastherighttoconfiscatethedepositaccordinglaws.十一、甲、乙双方均对本协议内容负有保密义务，不得向无关的第三方泄露，否则应当赔偿因此对方造成的损失。XI.BothPartyAandPartyBshallhavetheobligationtokeepconfidentialofthecontentsofthisagreement,shallnotdisclosetoanythirdparty,otherwiseitshallbeliableforthelosscausedbytheotherparty.十二、因本协议发生纠纷，甲、乙双方一致同意在甲方所在地人民法院诉讼解决；XII.Incaseofdispute,PartyAandPartyBbothpartiesagreetofilethelawsuitatthepeople'scourtintheplacewherePartyAislocated;十三、本协议书一式两份，由甲、乙双方各执一份，具有同等法律效力。XIII.Thisagreementismadeintwocopies,eachpartyshallholdonecopy,whichhasthesamelegaleffect.甲方（签章）：乙方签字：PartyA(signatureandseal):PartyBsignature:代表签字：Representativesignature:年月日年月日Date:Date:
