LabourContractEmployer:__________________________LegalRepresentative:_________________Position:_________President:________Address:__________Postcode:_______Employee:__________________________Name:_____________Gender:_________Address:__________Nationality:______IDCardNo.:________________________DateofBirth:_______________________EducationDegree:____________________ThisContractissignedonamutualityvoluntarybasisbyandbetweenthefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeople'sRepublicofChina.'1.TermoftheContract:Thetermofthiscontractisfor_____yearsandshallcommenceon_____,_____,andshallcontinueuntil_____,_____,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodof___months.2.JobDescription:TheEmployeragreestoemployMr./Ms.________(name)as________(jobtitle)in________Department,locatedin________(officelocationandcity).3.RemunerationofLaboura.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b.ThesalaryoftheEmployeeisRMB$______permonthintheprobationaryperiodandRMB$_____aftertheprobationaryperiod.c.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompany'sworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployee’swelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7.LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbytheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i.ThisContractisnotrenewedattheexpirationofthisContract;ii.TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii.ThedeathoftheEmployeeoccurs;iv.Theforcemajeuretakesplace;v.TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i.TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.Thecircu
