NotificationoftheVictim’sProceduralRightsandObligationsPursuanttotheCriminalProcedureLawofthePeople’sRepublicofChina,duringthecaseinvestigationbythepublicsecurityorgan,thevictimhasthefollowingrightsandobligations:Rights:1.Citizensofallnationalitiesshallhavetherighttousetheirnativespokenandwrittenlanguagesincourtproceedings.(Article9)2.Participantsinproceedingsshallhavetherighttofilechargesagainstinvestigatorswhoseactsinfringeontheircitizen'sproceduralrightsorsubjecttheirpersonstoindignities.(Article14)3.Inanyofthefollowingsituations,amemberofthejudicial,procuratorialorinvestigatorypersonnel,courtclerksandinterpretersshallvoluntarilywithdraw,andthepartiestothecaseandtheirlegalrepresentativesshallhavetherighttodemandhiswithdrawal:(1)ifheisapartyoranearrelativeofapartytothecase;(2)ifheoranearrelativeofhishasaninterestinthecase;(3)ifhehasservedasawitness,expertwitness,defenderoragentlitigantinthecurrentcase;(4)ifhehasanyotherrelationswithapartytothecasethatcouldaffecttheimpartialhandlingofthecase.Ifadecisionhasbeenmadetorejecthisapplicationforwithdrawal,thepartyorhislegalrepresentativemayapplyforreconsiderationonce.(Article28,30,31)4.Ifavictimhassufferedmateriallossesasaresultofthedefendant'scriminalact,heshallhavetherighttofileanincidentalcivilactionduringthecourseofthecriminalproceeding.(Article77)5.Ifthepublicsecurityorganbelievesthattherearenofactsofacrimeorthatthefactsareobviouslyincidentalanddonotrequireinvestigationofcriminalresponsibility,itshallnotfileacase.Ifthevictimdoesnotagreewiththedecision,hemayaskforreconsideration.6.Whereavictimconsidersthatacaseshouldbefiledforinvestigationbyapublicsecurityorganbutthelatterhasnotdoneso,thevictimcanbringthemattertothePeople’sProcuratorate.(Article87)7.Therecordofaninterrogationshallbeshowntothevictimforchecking.Ifthevictimcannotread,therecordshallbereadtohim.Ifthereareomissionsorerrorsintherecord,thevictimmaymakeadditionsorcorrections.Ifthevictimrequeststowriteavictimstatement,heshallbepermittedtodoso.(Article100)8.Theinvestigationorganshallnotifythevictimoftheconclusionoftheexpertverificationwhichwillbeusedasevidenceinhiscase.Asupplementaryexpertverificationoranotherexpertverificationmaybeconducteduponapplicationsubmittedbythevictim.(Article121)Obligations1.Thevictimshouldprovideevidenceandgivetestimonytruthfullyandshallbeinformedofthelegalresponsibilitythatshallbeincurredforintentionallygivingfalsetestimonyorconcealingcriminalevidence.(Article100)NotificationoftheWitness’sProceduralRightsandObligationsPursuanttotheCriminalProcedureLawofthePeople’sRepublicofChina,duringthecaseinvestigationbyapublicsecurityorgan,thewitnesshasthefollowingrightsandobligations:Rights:1.Citizensofallnationalitiesshallhavetherighttousetheirnativespokenandwrittenlanguagesincourtproceedings.(Article9)2.Participantsinproceedingsshallhavetherighttofilechargesagainstjudges,procuratorsandinvestigatorswhoseactsinfringeontheircitizen'sproceduralrightsorsubjecttheirpersonstoindignities.(Article14)3.ThePeople'sCourts,thePeople'sProcuratoratesandthepublicsecurityorgansshallinsurethesafetyofwitnessesandtheirnearrelatives.(Article49)4.Therecordofaninterrogationshallbeshowntothewitnessforchecking;ifthewitnesscannotread,therecordshallbereadtohim.Ifthereareomissionsorerrorsintherecord,thewitnessmaymakeadditionsorcorrections.Ifthewitnessrequeststowriteapersonalstatement,heshallbepermittedtodoso.(Article99)Obligations:1.Allthosewhohaveinformationaboutacaseshallhavethedutytotestify.(Article48)2.Thewitnessshallprovideevidenceandgivetestimonytruthfullyandshallbeinformedofthelegalresponsibilitythatshallbeincurredforintentionallygivingfalsetestimonyorconcealingcriminalevidence.(Article98)
