筑龙网’sGuideTheWorldBankWashington,D.C.May2006筑龙网(MDBs)andtheInternationalFederationofConsultingEngineers(FIDIC),totheconditionsofcontractthatthesetwogroupspreviouslyharmonized.ThesmallchangesintroducedinthisrevisionareaimedtofurtherimprovethebalanceofcontractrisksbetweentheEmployerandtheContractoralongcontractperformance.AnotherimportantrevisiontotheharmonizedconditionsofcontractistheinclusionofseveralversionsofGCClause15.6,CorruptorFraudulentPractices,eachonespecifictoeachparticipatingMBD.May2005RevisionThisrevisiondatedMay2005istoconform,totheextentpossiblewithoutcontraveningtheMay2004ProcurementGuidelines,tothemodelprovidedbytheMasterProcurementDocumentforProcurementofWorks&User’sGuideharmonizedamongvariousMultilateralDevelopmentBanks(MDBs)andapprovedbytheHeadsofProcurementoftheMDBsandInternationalFinancialInstitutions(IFIs)inOctober2004.Inthisrevision,twoalternativeSectionsIII,EvaluationandQualificationCriteria,areincluded.Oneisthedefaultalternativeandassumesthatprequalificationhastakenplacebeforebidding.Theotherisforthoseexceptionalcaseswhen,subjecttopriorapprovaloftheIBRD,postqualificationtakesplace.Themajorchangeintroducedinthisrevisionistheincorporation,underSectionVII,GeneralConditions,ofaharmonizedversionofcontractconditionswhichtexthasbeenagreedamongtheInternationalFederationofConsultingEngineers(FIDIC)andvariousMDBsforitsinclusionintheMasterProcurementDocumentsforProcurementofWorks&User’sGuide.TheharmonizationoftheGeneralConditionshasmadeunnecessarythegreatnumberofdeviationstotheGeneralConditionsofContract(FIDIC’s“ConditionsofContractforConstruction”),introducedintheformerSBDProcurementofWorksthroughParticularConditionsofContracttoaccountforallnon-applicablegeneralconditions.GiventhattheharmonizedGeneralConditionsisbasedextensivelyonFIDIC’s“ConditionsofContractforConstruction”,firstedition,publishedbyFIDICin1999,andbeingFIDICthesolecopyrightownerofsuchpublication,theIBRDhassubscribedalicenseagreementwithFIDICthatauthorizetheuseoftheharmonizedversionofsuchconditionsofcontractbytheBorrowersoftheWorldBankwhenpreparingbiddingdocumentsinaccordancewiththeseSBDProcurementofWorks.SectionVIII,ParticularConditions,consistsnowoftwoparts:PartA,comprisingtheContractDataandPartB,SpecificProvisions,containingclausesspecifictoeachcontract.WithinSectionVII,GeneralConditions,themostsignificantchangeistheintroductioninClause20,Claims,DisputesandArbitration,ofaDisputeBoardwhichmaybecomprisedofoneorthreemembers,asmaybedeterminedbytheEmployerandindicatedintheContractData(PartAofSectionVIII,ParticularConditions)withoutregardtotheestimatedcostofthecontract.筑龙网(SBDW)havebeenpreparedbytheWorldBanktobeusedfortheprocurementofadmeasurement(unitpriceorrate)typeofworksthroughInternationalCompetitiveBidding(ICB)inprojectsthatarefinancedinwholeorinpartbytheWorldBank.TheyareconsistentwiththeMay2004[editionofthe]GuidelinesforProcurementunderIBRDLoansandIDACredits.Thesebiddingdocumentsarenotsuitableforlumpsumcontractswithoutsubstantialchangestothemethodofpaymentandpriceadjustment,andtotheBillofQuantities,SchedulesofActivities,andsoforth.TheseSBDWarebasedontheJuly2004versionoftheMasterBiddingDocumentsforProcurementofWorksandUser’sGuide,preparedbytheMultilateralDevelopmentBanksandInternationalFinancingInstitutions.TheMasterBiddingDocumentsreflect“bestpractices”bytheseinstitutions.TheseSBDWreflectthestructureandtheprovisionsoftheMasterBiddingDocuments,exceptwherespecificconsiderationswithintheWorldBankhaverequiredachange.TheseSBDWaremandatoryforuseinmajorworkscontracts(thoseestimatedtocostmorethanUS$10million,includingcontingencyallowance)unlesstheBankagreestotheuseofotherBankStandardBiddingDocumentsonacase-by-casebasis.(TheBankhasalsoissuedacivillawversionoftheSBDWaswellasaSBDWforsmallercontracts.)TheseSBDWassumethatprequalificationhastakenplacebeforebidding.TheprocessofprequalificationshallfollowtheprocedureindicatedinStandardPrequalificationDocuments:ProcurementofWorks,issuedbytheWorldBank.Prequalificationshallbefollowedforallmajorworks.Exceptionally,withpreviousapprovaloftheWorldBank,post-qualificationmightbeappropriate.AnalternativeSectionIII,EvaluationandQualificationCriteria,isalsoprovidedtoaddressthisexceptionalpossibility.Thedocumentisorganizedintotwo(2)maincomponents:•TheStandardBiddingDocument;and•AUser’sGuideforProcurementofWorksThosewishingtosubmitcommentsorquestionsontheseBiddingDocumentsortoobtainadditionalinformationonprocurementunderWorldBank-financedprojectsareencouragedtocontact:筑龙网’sGuideapplyeitherwhenaprequalificationprocesshastakenplacebeforebiddingorwhenaprequalificationprocesshasnottakenplacebeforebidding(providedalternativ
