CHINESEMODELBIDDINGDOCUMENTSPROCUREMENTOFGOODSUNDERNATIONALCOMPETITIVEBIDDING(NCB)MinistryofFinanceThePeople’sRepublicofChinaJanuary2012SummaryDescriptionPrefaceInordertoregulateandstandardizeprocurementactivitiesofWorldBankfinancedprojectsinChina,in1991theMinistryofFinance(MOF)organizedtoproduceandpublishedModelBiddingDocumentsforWorldBankFinancedProjects(MBDs),whichwererevisedin1993byMOFandtheWorldBankbasedontrialuseofthesedocuments.In1995,theWorldBankreviseditsProcurementGuidelinesandthendevelopedandpublishedStandardBiddingDocuments(SBDs)forWorldBankfinancedprojects,andrequestedthatitsborrowersmustuseSBDsinWorldBankfinancedprojects.Afterextensiveconsultations,MOFandtheWorldBankagreedtoreviseandupdateMBDsdevelopedsince1991inreferencetoSBDs.TherevisedandupdatedMBDswerere-publishedin1997.Overthepast20years,useofMBDshasplayedapositiveroleinregulatingandstandardizingprocurementactivitiesofWorldBankfinancedprojectsinChinaandhasalsoproducedfavorableimpactsonthedevelopmentofChina’srelevantprocurementsystems.InOctober2001,multilateraldevelopmentbanksandrelevantinternationalfinancialinstitutionsproducedandpublishedHarmonizedBiddingDocumentsandUser’sGuide.Theseharmonizeddocumentsextensivelyreflect“bestpractice”resultsoftheseinternationalinstitutions.TheWorldBank’sSBDspreparedbasedontheharmonizedbiddingdocumentshavesincebeenusedininternationalcompetitivebiddingactivitiesforWorldBankfinancedprojectsinChina.Inrecentyearsandinresponsetothedevelopingandchangingsituation,internationalfinancialinstitutionsincludingtheWorldBankhavebeenrevisingandimprovingtheirprocurementpoliciesandbeguntoemphasizeandpromotetheuseofcountryprocurementsystemsinprojectsfinancedbythem.Meanwhile,inrecentyearsChina’sdomesticprojectdevelopmentenvironmentshaveexperiencedremarkablechanges,procurementrelatedlawsandinstitutionshavebeenimproving,andcarryingoutopentenderinganduseofSBDsinpublicprocurementhavebeenwidelyaccepted.Thesehavehadsomepositiveeffectsonbiddingactivities,especiallynationalcompetitivebidding(NCB)activitiesofprojectsfinancedbytheWorldBankandotherinternationalfinancialinstitutions.BasedontheaboveandconsideringthattheoperationsofAsianDevelopmentBank(ADB)havealsobeenmanagedbyMOFsincethe1998institutionalreform,inordertoadapttoadevelopingsituation,furtherstrengthenmanagementofprojectsfinancedbyinternationalfinancialinstitutionsandregulateandstandardizerelevantprocurementactivities,withtheassistancefromtheWorldBankandADB,MOFconductedcomprehensiverevisionofModelNCBProcurementDocumentsforWorldBankFinancedProjectsandchangedthenametoModelNCBProcurementDocumentsforProjectsFinancedbyInternationalFinancialInstitutions(thenewMBDs)toenabletheirbroaderapplication.ThenewMBDshaveadequatelyconsideredChina’srelevantprocurementlawsandregulationsaswellasrequirementsintheWorldBank’sandADB’sprocurementguidelinesandpolicies,reflectingthecost-effectiveness,efficiencyandtransparencyprinciplesthatshallbecompliedwithintheprocurementcycleandstressingtherequirementsoffightingagainstfraudandcorruptioninprocurement.ThenewMBDsapplytoNCBprocurementactivitiesforalllendingandgrantprojectsfinancedbytheWorldBankandADBinChina.Inthemeantime,MOFencouragesuseofnewMBDsforNCBprocurementactivitiesofprojectsfinancedbyotherinternationalfinancialinstitutions.SummaryDescriptionThenewMBDsincludeNationalCompetitiveBiddingDocumentforProcurementofGoodsandNationalCompetitiveBiddingDocumentforProcurementofCivilWorks.ThetwodocumentshavebothChineseandEnglishversionssothattheycanmeettheneedsofdifferentlanguageusers.ThenewMBDscomprisethreepartsandninechapters.PartOneprovidesbiddingprocedures,includingInstructionstoBidders,BiddingDataSheet,BidEvaluationandQualificationCriteria,BiddingDocumentFormatandEligibleCountries;PartTwospecifiesprocurementrequirements,includingDemandforSupplyofGoodsorBuyer’sRequirements;PartThreerelatestocontract,includingGeneralConditionsofContract,SpecialConditionsofContractandContractFormat.Consideringtheirwidespreadapplicationandproject-specificconditions,thenewMBDsincludefixedclausesandvariableclauses.Fixedclausesareuniversallyapplicableclausesthatcannotbechanged;variableclausesareclausesthatcanbeadjustedaccordingtoproject-specificconditionsandprocurementrequirements.ConcreteprocurementrequirementsandspecialcontractprovisionscanbereflectedinBiddingDataSheetandSpecialContractClauses.IntheprocessofrevisingandpreparingthenewMBDs,greatsupportandassistancehavebeenreceivedfromADBandWorldBankprocurementspecialists.Theireffortsandcontributionsareappreciated.InternationalDepartmentMinistryofFinanceThePeople’sRepublicofChinaJanuary2012SummaryDescriptioniProcurementofGoodsSummaryInvitationforBids(IFB)PART1–BIDDINGPROCEDURESSectionI.InstructionstoBidders(ITB)ThisSectionprovidesinformationtohelpBidderspreparetheirbids.Informationisalsoprovidedonthesubmission,opening,andevaluationofbidsandontheawardofContracts.SectionIcontainsprovisionsthataretobeusedwithoutmodification.SectionII.BiddingDataSheet(BDS)ThisSectionincludesprovisionsthatarespecifictoeachprocurementandthatsupplementSe
