1.Thefairdismissalhasthosereasons:Incapability,itcoversissuesinrelationtohealthandmentalcapabilities.Thisismeansiftheemployeeisn’thavingenoughskillsandknowledgeonthework,thecompanyhasrightstodismissaltheemployees.Misconduct,thisistheemployee’sbehaviorisn’tdecentandfittheorganizationsrules.Theorganizationwillhavedifferentideasastowhatconstitutesmisconduct.thecommonareasthatallorganizationswillmostlikelyagreeonisbelateforwork,absenceillegaldrugsoralcohol,internetabuse,physicalassaultandseriousdamagetocompanyproperty.insomeorganizationsitmightbeperfectlyappropriatetoarriveatworkwearingextremelycasualclothessuchasscruffydenimjeans,whereasinanotherorganization,dressingthisisalackofrespect.Redundancy,thisismeansiftheorganization’semployeeistoomuch,theorganizationcannotaffordthem.,thentheorganizationcandismissaltheemployee,itisthefairdismissalFailuretohavequalificationsrelevanttothejob,forexamplealorrydriverwhoisdisqualifiedfromdriving.Goingoutonanunlawfulstrike,aslongastheemployeewasnotsingledoutforthistreatmentandallstrikingemployeesweretreatedalike.2,UnfairDismissaliswhenthefollowinghappens:aAnemployeeisdismissedandtheyqualifyfortherighttobringanUnfairDismissalclaim.b.Theemployerdidnothaveafairreasontodismisstheemployee.c.Or,theemployerdidhaveafairreason,butthematterwasdealtwithunfairly.TherearethreefundamentalquestionsthatanEmploymentTribunalwouldbeseeking:a.Paycompensationtotheemployee.b.Reinstatethedismissedemployeebackintheiroriginpost.c.Re-engagethedismissedemployeeintheorganizationnotnecessarilyintheiroriginalpost,butinanequivalentpost.3.theintentionofidentifyingautomaticallyunfairreasonsfordismissalistoensurethatanemployeeisnottreatedharshlyordisadvantagedbyanemployerforupholdingtheiremploymentrights.employeearesomewhatprotectedbytherebeingcertainreasonsfordismissalthatareautomaticallyunfair.anemployeecanmakeacomplaintofunfairdismissaliftheyaredismissedforanyofthesespecificreasons,regardlessoftheirperiodofservice.inotherwords,thereis‘noqualifyingperiodsofservice’formakingacomplaintofunfairdismissalifthereasonfordismissalisincludedbelow:TradeunionmembershiporactivitiesDismissalonmaternityrelatedgroundsDismissalfortaking,orproposingtotake,someactiononhealthandsafetygrounds,forexampletryingtobeingahealthandsafetyissuetoanemployer’sattentionDismissalforhavingsoughttoexerciseastatutoryemploymentright,forexampleallegingthatanemployerhasinfringedanemployee’srighttoaminimumperiodofnotice,oranyformofunlawfuldiscriminationPerformingorproposingtoperformdutiesinconnectionwithanemployee’sroleasanemployeeoccupationaltrustee.Anemployeetrusteecouldhavetoquestiontheirabouttheirfinancialtransactions.Reasonsconnectedwiththetransferofaundertakingfromoneemployertoanotheremployer.Unliketheotherreasonsinthislist,anemployeemusthaveatleasttwoyears’servicebeforetheycouldbringaclaimagainsttheiremployerforthistypeofdismissalAnydismissalwheretheminimumstatutoryprocedureshavenotbeenfollowedwillbedeemedtobeanautomaticallyunfairdismissal.However,inthesecircumstances,aminimumofoneyear’scontinuousserviceisrequiredtomakeaclaim.4.wrongfuldismissalisinacategorysomewhatseparatefromothertypesofdismissal.wrongfuldismissaloccurswheretheemployerisinbreachofcontractindismissinganemployee.Unfairdismissaloccurswheretheemployerisinbreachofastatutorydutytotreattheemployeefairly.Thereasonsforwrongfuldismissalaretheemployeeisdismissedwithoutnotice;theemployeeiddismissedwithoutsufficientnoticeandtheemployeeissummarilydismissedwithoutgoodcause.Constructivedismissalisatermusedtodescribethesituationwhereanemployeeleavestheirjobbecauseoftheemployer’sbehavior.Constructivedismissaloccurswhereanemployeeresignsbecausetheemployer’sactionsmusthaveamountedtoafundamentalbreachofcontract.Theexamplesofconstructivedismissalhavefailingtosupportmanagersindifficultworksituations,harassingorhumiliatingstaff,victimizingortargetingaparticularmemberofstafffornojustifiablereason,changingtheemployee’sjobcontentorconditionsofemploymentwithoutconsultation,makingasignificantchangeintheemployee’susualplaceofworkatshortnoticeandfalselyaccusinganemployeeofmisconductsuchastheftorofbeingincapableofcarryingouttheirjob.WrongfulDismissalandConstructiveDismissalarealldifferentfromunfairdismissal.Wrongfuldismissaloccurswheretheemployerisinbreachofcontractindismissinganemployee.Unfairdismissaloccurswheretheemployerisinbreachofastatutorydutytotreattheemployeefairly.ConstructiveDismissalistheemployeeinitiativelyresign,butunfairdismissalisemployeehavebeendismissaloftheircompany.5.Ifanemployeefeelsthattheiremployerhasunfairlydismissedthem,theymaybeentitledtohavetheircomplaintconsiderbeforeanEmploymentTribunal,providedtheymeetthefollowingcriteria:Anemployeemustbeemployedonafullorpart-timebasis.Theamountofhoursworkedperweekisirrelevant.Anemployeemusthaveoneyear’scontinuousemployment.Anemployeemustbebelowthenormalretirementage.6.Thefactorsthatatribunaltakesintoaccountindecidingwhetherornotanemployerhasactedappropriatelywhendismissinganemployeeare:A.hastheemployersactedreasonablyintreatingtheemploy
