LABORCONTRACTNameofEmployer:XXXXXXXXXXXXXXX.(hereinafterreferredtoasPartyA)Address:XXXXXXXXXXXXXXXLegalRepresentative:XXXXXXXXXXXXXXXContact:XXXXXXXXXXXXXXXTelephone:XXXXXXXXXXXXXXXandNameofEmployee:XXXXXXXXXXXXXXX(hereinafterreferredtoasPartyB)Gender:MaleIdentificationCardNo.:XXXXXXXXXXXXXXXLivingaddress:XXXXXXXXXXXXXXXTelephone:+XXXXXXXXXXXXXXXHerebyexecutethisContractinaccordancewiththeapplicableprovisionsofTheLaborLawofthePeople'sRepublicofChinaandotherlawsandregulationsonthebasisofequality,voluntarinessandconsensus.Article1TermofContractandProbationPeriod1.BothPartyAandPartyBagreesthatthetermofthisContractshallbefromXXXXXXXXXXXXXXXtoXXXXXXXXXXXXXXX.2.Thereshallbeaprobationperiodof3months,fromXXXXXXXXXXXXXXXtoXXXXXXXXXXXXXXX.(Probationperiodisincludedintheperiodofcontract;ifthereisnoprobationperiod,filltheblankwith“Zero”)Article2JobPositionandJobDuties1.PartyBshallholdthepositionofXXXXXXXXXXXXXXXwiththedepartmentofXXXXXXXXXXXXXXXDepartment.PartyBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.2.PartyB'sjobareashallbePartyA'sbusinessarea,whichincludesXXXXXXXXXXXXXXXArticle3Workinghoursandvacations1.PartyAandPartyBagreewiththefollowingworkinghours.Standardworkinghoursbasedonnationalregulation,8hourseachday,40hourseachweek,withatleast1dayresteachweek.2.VacationWithintheperiodofcontract,PartyBshallhaveallholidays,vacationsasnationalregulationsgranted;besides,ifPartyBbeinoccupationalinjuryorintheperiodofpregnancyandnursingperiod,PartyAshallfollownationalregulationsintermsofcompensationandwelfare.Article4Compensation1.InaccordancewiththecurrentsalarysystemofPartyA,PartyB'stotalyearlysalaryshallbeRMBXXXXXXXXXXXXXXX,whichmeansmonthlyRMBXXXXXXXXXXXXXXX.Attheendoftheprobationperiod,PartyB'smonthlysalaryshallbeissuedinthefollowingmanner.2.Basedontheperformance,PartyBshallbeentitledtoreceiveuptoRMBXXXXXXXXXXXXXXXasannualbonus.Thecriteriaforprovisionoftheannualbonusarethegoalsachievedandtheevaluationoftheperformanceofyoubytheresponsiblesuperior.3.PartyAshallissuethesalaryforthemonthlysalaryonthelastdayofeachmonth.PartyAshouldissuethesalarythesalaryinformofcurrencyatleastonceamonth.4.Theabovesalaryistheincomebeforetax.PartyB'spersonalincomeadjustmenttaxandotherrelatedcostshallbewithheldbyPartyA.5.PartyBmustnotprovideserviceandbepaidbyotherbusinessentities;otherwise,PartyApreserverightstoterminatecontractsandshallbesubjecttoadministrativesanctionsorlegalliabilities.6.Employee’ssalaryisoneofthecompany’sbusinesssecretsandPartyAmaintainsastrictpolicyonconfidentiality.PartyBmustcomplywiththeconfidentialitypolicy,andcannotdisclose,announce,publish,ordisseminateinanymannerhisorotheremployees’salarytootherpartieswithcompany’swrittenapproval.Nomatterwhenleavescompany,PartyBshallkeepdetailofSalaryconfidentialforatleast2years;otherwise,onceprovedthatPartyBexposesdetailofSalaryandthuscausesgreatlossofPartyA,PartyApreservesrightstoclaimcompensationfromPartyAandshallbesubjecttoadministrativesanctionsorlegalliabilities.Article5SocialInsurance,WelfareandBenefits1.PartyAshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyB'sbehalfinatimelymannerinaccordancewithNational,ProvinceorCitygovernmentrequirements.2.PartyBshallbeentitledtovariouskindsofallowance,welfarebyPartyAasspecifiedbytheregulationsandrelatedlawsofChineseGovernment.Article6LaborProtection,LaborConditionandOccupationalRiskProtection1.AccordingtoNational,ProvinceandCitygovernmentrequirementonlaborprotection,PartyAshallprovidenecessaryequipmentsandsuppliesaccordingtoNationalSecurityandSanitationStandards,toprotectPartyB’shealthandsecurityinwork.2.AccordingtoNational,ProvinceandCityGovernmentrequirement,PartyAshallspeciallyprotectfemaleandunder-agedemployees.Article7RegulationsandRules1.PartyAshallpreparerulesandregulationsinaccordancewithlawandmustnotifyPartyB.2.PartyBshallstrictlycomplywiththeNational,Provincialandcityrelevantlawandregulationsofthecompanywhichinaccordancewithlawinanexemplarymanner.PartyBshallcompletethejobontime,improveprofessionalskills,followtheregulationofsafetyoperationandoccupationalethics.3.PartyBshallconsciouslycomplywithNational,ProvinceandCity’sregulationsonOne-ChildPolicy.Article8Changesto,andDissolutionof,TerminationofLaborContract1.InaccordancewithLawofEmploymentContract’sStipulationconditionoruponconsensusbetweenPartyAandPartyB,therelevantcontentsofthisContractmaybechangedortheLaborContractmaybeterminated.2.PartyBmustgivePartyA30daysofwrittennoticewhenherequeststerminationofthisLaborContract;PartyBmustgivePartyA3daysofwrittennoticewhenherequeststerminationofthisLaborContractwithintheprobationperiod.3.UponthePartyB’soccurrenceofanyoneofthefollowingcircumstances,PartyAmayterminatethisLaborContract,withoutadvancewrittennoticeandcompensationtoPartyB:a)PartyBisprovedthathedoesnotmeettheemploymentrequirementsduringtheprobationperiod,PartyAmayterminatetheLaborContractbeforetheendoftheprobation;b)PartyBflagrantviolateslabordisciplines,rulesorregulationsofthecompany;;c)PartyBhasgrossneglectofdutyorpracticesgraft,andwhichcauseserious
