()111501198903()198904041990100119894419894419901011989441990101ADMINISTRATIVEPROCEDURELAWOFTHEPEOPLE'SREPUBLICOFCHINAImportantNotice:(),(19917).,.ThisEnglishdocumentiscomingfromLAWSANDREGULATIONSOFTHEPEOPLE'SREPUBLICOFCHINAGOVERNINGFOREIGN-RELATEDMATTERS(1991.7)whichiscompiledbytheBrueauofLegislativeAffairsoftheStateCouncilofthePeople'sRepublicofChina,andispublishedbytheChinaLegalSystemPublishingHouse.Incaseofdiscrepancy,theoriginalversioninChineseshallprevail.WholeDocument()ADMINISTRATIVEPROCEDURELAWOFTHEPEOPLE'SREPUBLICOFCHINA(AdoptedattheSecondSessionoftheSeventhNationalPeople'sCongressonApril4,1989,promulgatedbyOrderNo.16ofthePresidentofthePeople'sRepublicofChinaonApril4,1989,andeffectiveasofOctober1,1990)ContentsChapterIGeneralProvisionsChapterIIScopeofAcceptingCasesChapterIIIJurisdictionChapterIVParticipantsinProceedingsChapterVEvidenceChapterVIBringingaSuitandAcceptingaCaseChapterVIITrialandJudgmentChapterVIIIExecutionChapterIXLiabilityforCompensationforInfringementofRightsChapterXAdministrativeProcedureInvolvingForeignInterestChapterXISupplementaryProvisionsChapterIGeneralProvisionsArticle1PursuanttotheConstitution,thisLawisenactedforthepurposeofensuringthecorrectandprompthandlingofadministrativecasesbythepeople'scourts,protectingthelawfulrightsandinterestsofcitizens,legalpersonsandotherorganizations,andsafeguardingandsupervisingtheexerciseofadministrativepowersbyadministrativeorgansinaccordancewiththelaw.Article2Ifacitizen,alegalpersonoranyotherorganizationconsidersthathisoritslawfulrightsandinterestshavebeeninfringeduponbyaspecificadministrativeactofanadministrativeorganoritspersonnel,heoritshallhavetherighttobringasuitbeforeapeople'scourtinaccordancewiththisLaw.Article3Thepeople'scourtsshall,inaccordancewiththelaw,exercisejudicialpowerindependentlywithrespecttoadministrativecases,andshallnotbesubjecttointerferencebyanyadministrativeorgan,publicorganizationorindividual.Thepeople'scourtsshallsetupadministrativedivisionsforthehandlingofadministrativecases.Article4Inconductingadministrativeproceedings,thepeople'scourtsshallbasethemselvesonfactsandtakethelawasthecriterion.Article5Inhandlingadministrativecases,thepeople'scourtsshallexaminethelegalityofspecificadministrativeacts.Article6Inhandlingadministrativecases,thepeople'scourtsshall,asprescribedbylaw,applythesystemsofcollegialpanel,withdrawalofjudicialpersonnelandpublictrialandasystemwherebythesecondinstanceisthefinalinstance.Article7Partiestoanadministrativesuitshallhaveequallegalpositions.Article8Citizensofallnationalitiesshallhavetherighttousetheirnativespokenandwrittenlanguagesinadministrativeproceedings.Inanareawherepeopleofaminoritynationalityliveinconcentratedcommunitiesorwhereanumberofnationalitieslivetogether,thepeople'scourtsshallconductadjudicationandissuelegaldocumentsinthelanguageorlanguagescommonlyusedbythelocalnationalities.Thepeople'scourtsshallprovideinterpretationforparticipantsinproceedingswhodonotunderstandthelanguageorlanguagescommonlyusedbythelocalnationalities.Article9Partiestoanadministrativesuitshallhavetherighttodebate.Article10Thepeople'sprocuratoratesshallhavetherighttoexerciselegalsupervisionoveradministrativeproceedings.ChapterIIScopeofAcceptingCasesArticle11Thepeople'scourtsshallacceptsuitsbroughtbycitizens,legalpersonsorotherorganizationsagainstanyofthefollowingspecificadministrativeacts:(1)anadministrativesanction,suchasdetention,fine,rescissionofalicenseorpermit,ordertosuspendproductionorbusinessorconfiscationofproperty,whichonerefusestoaccept;(2)acompulsoryadministrativemeasure,suchasrestrictingfreedomofthepersonorthesealingup,seizingorfreezingofproperty,whichonerefusestoaccept;(3)infringementuponone'smanagerialdecision-makingpowers,whichisconsideredtohavebeenperpetratedbyanadministrativeorgan;(4)refusalbyanadministrativeorgantoissueapermitorlicense,whichoneconsidersoneselflegallyqualifiedtoapplyfor,oritsfailuretorespondtotheapplication;(5)refusalbyanadministrativeorgantoperformitsstatutorydutyofprotectingone'srightsofthepersonandofproperty,asonehasappliedfor,oritsfailuretorespondtotheapplication;(6)caseswhereanadministrativeorganisconsideredtohavefailedtoissueapensionaccordingtolaw;(7)caseswhereanadministrativeorganisconsideredtohaveillegallydemandedtheperformanceofduties;and(8)caseswhereanadministrativeorganisconsideredtohaveinfringeduponotherrightsofthepersonandofproperty.Apartfromtheprovisionssetforthintheprecedingparagraphs,thepeople'scourtsshallacceptotheradministrativesuitswhichmaybebroughtinaccordancewiththeprovisionsofrelevantlawsandregulations.Article12Thepeople'scourtsshallnotacceptsuitsbroughtbycitizens,legalpersonsorotherorganizationsagainstanyofthefollowingmatters:(1)actsofthestateinareaslikenationaldefenceandforeignaffairs;(2)administrativerulesandregulations,regulations,ordecisionsandorderswithgeneralbindingforceformulatedandannouncedbyadministrativeorgans;(3)decisionsofanadministrativeorganonawardsorpunishmentsforitspersonnelorontheappointmentorreliefofdutiesofitspersonnel;and(4)specificadminist
