EnvironmentalProtectionLawofthePeoplesRepublicofChinaContentChapterIGeneralProvisionsChapterIISupervisionandManagementoftheEnvironmentChapterIIIProtectionandImprovementoftheEnvironmentChapterIVPreventionandControlofEnvironmentalPollutionandOtherPublicHazardsChapterVLegalLiabilityChapterVISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisformulatedforthepurposeofprotectingandimprovingpeople'senvironmentandtheecologicalenvironment,preventingandcontrollingpollutionandotherpublichazards,safeguardinghumanhealthandfacilitatingthedevelopmentofsocialistmodernization.Article2EnvironmentasusedinthisLawreferstothetotalbodyofallnaturalelementsandartificiallytransformednaturalelementsaffectinghumanexistenceanddevelopment,whichincludestheatmosphere,water,seas,land,minerals,forests,grasslands,wildlife,naturalandhumanremains,naturereserves,historicsitesandscenicspots,andurbanandruralareas.Article3ThisLawshallapplytotheterritoryofthePeople'sRepublicofChinaandotherseaareasunderthejurisdictionofthePeople'sRepublicofChina.Article4Theplansforenvironmentalprotectionformulatedbythestatemustbeincorporatedintothenationaleconomicandsocialdevelopmentplans;thestateshalladopteconomicandtechnologicalpoliciesandmeasuresfavourableforenvironmentalprotectionsoastocoordinatetheworkofenvironmentalprotectionwitheconomicconstructionandsocialdevelopment.Article5Thestateshallencouragethedevelopmentofeducationinthescienceofenvironmentalprotection,strengthenthestudyanddevelopmentofthescienceandtechnologyofenvironmentalprotection,raisethescientificandtechnologicallevelofenvironmentalprotectionandpopularizescientificknowledgeofenvironmentalprotection.Article6Allunitsandindividualsshallhavetheobligationtoprotecttheenvironmentandshallhavetherighttoreportonorfilechargesagainstunitsorindividualsthatcausepollutionordamagetotheenvironment.Article7ThecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilshallconductunifiedsupervisionandmanagementoftheenvironmentalprotectionworkthroughoutthecountry.Thecompetentdepartmentsofenvironmentalprotectionadministrationofthelocalpeople'sgovernmentsatorabovethecountylevelshallconductunifiedsupervisionandmanagementoftheenvironmentalprotectionworkwithinareasundertheirjurisdiction.Thestateadministrativedepartmentofmarineaffairs,theharboursuperintendencyadministration,thefisheriesadministrationandfishingharboursuperintendencyagencies,theenvironmentalprotectiondepartmentofthearmedforcesandtheadministrativedepartmentsofpublicsecurity,transportation,railwaysandcivilaviationatvariouslevelsshall,inaccordancewiththeprovisionsofrelevantlaws,conductsupervisionandmanagementofthepreventionandcontrolofenvironmentalpollution.Thecompetentadministrativedepartmentsofland,minerals,forestry,agricultureandwaterconservancyofthepeople'sgovernmentsatorabovethecountylevelshall,inaccordancewiththeprovisionsofrelevantlaws,conductsupervisionandmanagementoftheprotectionofnaturalresources.Article8Thepeople'sgovernmentshallgiveawardstounitsandindividualsthathavemadeoutstandingachievementsinprotectingandimprovingtheenvironment.ChapterIISupervisionandManagementoftheEnvironmentArticle9ThecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilshallestablishthenationalstandardsforenvironmentquality.Thepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishtheirlocalstandardsforenvironmentqualityforitemsnotspecifiedinthenationalstandardsforenvironmentqualityandshallreportthemtothecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilfortherecord.Article10ThecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilshall,inaccordancewiththenationalstandardsforenvironmentqualityandthecountry'seconomicandtechnologicalconditions,establishthenationalstandardsforthedischargeofpollutants.Thepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishtheirlocalstandardsforthedischargeofpollutantsforitemsnotspecifiedinthenationalstandards;withregardtoitemsalreadyspecifiedinthenationalstandards,theymaysetlocalstandardswhicharemorestringentthanthenationalstandardsandreportthesametothecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilfortherecord.Unitsthatdischargepollutantsinareaswherethelocalstandardsforthedischargeofpollutantshavebeenestablishedshallobservesuchlocalstandards.Article11ThecompetentdepartmentofenvironmentalprotectionadministrationundertheStateCouncilshallestablishamonitoringsystem,formulatethemonitoringnormand,inconjunctionwithrelevantdepartments,organizeamonitoringnetworkandstrengthenthemanagementofenvironmentalmonitoring.ThecompetentdepartmentsofenvironmentalprotectionadministrationundertheStateCouncilandgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallregularlyissuebulletinsonenvironmentalsituations.Article12Thecompetentdepartmentsofenvironmentalprotectionadministratio
