Thisdocumentismeantpurelyasadocumentationtoolandtheinstitutionsdonotassumeanyliabilityforitscontents►BCOMMISSIONREGULATION(EC)No1881/2006of19December2006settingmaximumlevelsforcertaincontaminantsinfoodstuffs(TextwithEEArelevance)(OJL364,20.12.2006,p.5)Amendedby:OfficialJournalNopagedate►M1CommissionRegulation(EC)No1126/2007of28September2007L2551429.9.2007►M2CommissionRegulation(EC)No565/2008of18June2008L1602019.6.2008►M3CommissionRegulation(EC)No629/2008of2July2008L17363.7.2008►M4CommissionRegulation(EU)No105/2010of5February2010L3576.2.2010►M5CommissionRegulation(EU)No165/2010of26February2010L50827.2.2010►M6CommissionRegulation(EU)No420/2011of29April2011L111330.4.2011►M7CommissionRegulation(EU)No835/2011of19August2011L215420.8.2011►M8CommissionRegulation(EU)No1258/2011of2December2011L320153.12.2011►M9CommissionRegulation(EU)No1259/2011of2December2011L320183.12.2011►M10CommissionRegulation(EU)No219/2012of14March2012L75515.3.2012►M11CommissionRegulation(EU)No594/2012of5July2012L176436.7.2012►M12CommissionRegulation(EU)No1058/2012of12November2012L3131413.11.20122006R1881—EN—03.12.2012—009.001—1COMMISSIONREGULATION(EC)No1881/2006of19December2006settingmaximumlevelsforcertaincontaminantsinfoodstuffs(TextwithEEArelevance)THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanCommunity,HavingregardtoCouncilRegulation(EEC)No315/93of8February1993layingdownCommunityproceduresforcontaminantsinfood(1),andinparticularArticle2(3)thereof,Whereas:(1)CommissionRegulation(EC)No466/2001of8March2001settingmaximumlevelsforcertaincontaminantsinfoodstuffs(2)hasbeenamendedsubstantiallymanytimes.ItisnecessarytoamendagainmaximumlevelsforcertaincontaminantstotakeintoaccountnewinformationanddevelopmentsinCodexAlimentarius.Atthesametime,thetextshould,whereappro­priate,beclarified.Regulation(EC)No466/2001shouldthereforebereplaced.(2)Itisessential,inordertoprotectpublichealth,tokeepcontaminantsatlevelswhicharetoxicologicallyacceptable.(3)InviewofdisparitiesbetweenthelawsofMemberStatesandtheconsequentriskofdistortionofcompetition,forsomecontaminantsCommunitymeasuresarenecessaryinordertoensuremarketunitywhileabidingbytheprincipleofpropor­tionality.(4)Maximumlevelsshouldbesetatastrictlevelwhichisreasonablyachievablebyfollowinggoodagricultural,fisheryandmanufacturingpracticesandtakingintoaccounttheriskrelatedtotheconsumptionofthefood.Inthecaseofcontaminantswhichareconsideredtobegenotoxiccarcinogensorincaseswherecurrentexposureofthepopulationorofvulnerablegroupsinthepopulationisclosetoorexceedsthetolerableintake,maximumlevelsshouldbesetatalevelwhichisaslowasreasonablyachievable(ALARA).Suchapproachesensurethatfoodbusinessoperatorsapplymeasurestopreventandreducethecontaminationasfaraspossibleinordertoprotectpublichealth.Itisfurthermoreappropriateforthehealthprotectionofinfantsandyoungchildren,avulnerablegroup,toestablishthelowestmaximumlevels,whichareachievablethroughastrictselectionoftherawmaterialsusedforthemanufacturingoffoodsforinfantsandyoungchildren.Thisstrictselectionoftherawmaterialsisalsoappropriatefortheproductionofsomespecificfoodstuffssuchasbranfordirecthumanconsumption.▼B2006R1881—EN—03.12.2012—009.001—2(1)OJL37,13.2.1993,p.1.RegulationasamendedbyRegulation(EC)No1882/2003oftheEuropeanParliamentandoftheCouncil(OJL284,31.10.2003,p.1).(2)OJL77,16.3.2001,p.1.RegulationaslastamendedbyRegulation(EC)No199/2006(OJL32,4.2.2006,p.32).(5)Toallowmaximumlevelstobeappliedtodried,diluted,processedandcompoundfoodstuffs,wherenospecificCommunitymaximumlevelshavebeenestablished,foodbusinessoperatorsshouldprovidethespecificconcentrationanddilutionfactorsaccompaniedbytheappropriateexperimentaldatajustifyingthefactorproposed.(6)Toensureanefficientprotectionofpublichealth,productscontainingcontaminantsexceedingthemaximumlevelsshouldnotbeplacedonthemarketeitherassuch,aftermixturewithotherfoodstuffsorusedasaningredientinotherfoods.(7)Itisrecognisedthatsortingorotherphysicaltreatmentsmakeitpossibletoreducetheaflatoxincontentofconsignmentsofgroundnuts,nuts,driedfruitandmaize.Inordertominimisetheeffectsontrade,itisappropriatetoallowhigheraflatoxincontentsforthoseproductswhicharenotintendedfordirecthumanconsumptionorasaningredientinfoodstuffs.Inthesecases,themaximumlevelsforaflatoxinsshouldbefixedtakingintoconsiderationtheeffectivenessoftheabove-mentionedtreatmentstoreducetheaflatoxincontentingroundnuts,nuts,driedfruitandmaizetolevelsbelowthemaximumlimitsfixedforthoseproductsintendedfordirecthumanconsumptionoruseasaningredientinfoodstuffs.(8)Toenableeffectiveenforcementofthemaximumlevelsforcertaincontaminantsincertainfoodstuffs,itisappropriatetoprovideforsuitablelabellingprovisionsforthesecases.(9)BecauseoftheclimaticconditionsinsomeMemberStates,itisdifficulttoensurethatthemaximumlevelsarenotexceededforfreshlettuceandfreshspinach.TheseMemberStatesshouldbeallowedforatemporaryperiodtocontinuetoauthorisethemarketingoffreshlettuceandfreshspinachgrownandintendedforconsumptionintheirterritorywithnitratecontentsexceedingthemaximumlevels.L
