上海交通大学硕士学位论文心理契约视角下的律师激励姓名:孙飞申请学位级别:硕士专业:公共管理指导教师:万晓玲20070603WTOMOTIVATIONLAWYERSUNDERPSYCHOLOGICALCONTRACTABSTRACTPsychologicalcontractisakindofsubjectivementalagreementaboutwhattopayandwhattogetbetweentheemployeesandtheorganizationsimultaneously,includingtheexpectationofmutualresponsibilityandcognitionofonesownobligationcorrectly.Theproposalofthisconceptistoemphasizethatintherelationshipbetweentheemployeesandtheorganization,besidestheformalwrittenstipulations,thereisalsosomerecessive,informalandunexposedmutualexpectation.Intheresearchofhumanresourcemanagementandorganizationalconduct,itisanewfieldofvisiontostudytheinfluenceofpsychologicalcontracttotheemployees.Inthetrendofthemanagementpatternofpeopleforemost,thefocusofemployeeinspiritinghasturnedtobegentleandwiththefeatureofindividualcare.Psychologicalcontractenlightensanewfieldoftheemployeeinspiriting,puttingthefocusintothemicrocosmicrealmoftherelationshipbetweenorganizationsandemployees.TheentrancetoWTOofourcountrybringsnotonlyopportunitiesbutalsochallengesfortheprofessionoflawyer.Inthesituationofthefierceinternationalcompetition,howtoadministrateandattracttalentsisofgreatimportanceforthesurvivalofalawoffice.Thisessayaimstoprobeacountermeasuretosetupagoodpsychologicalcontractsoastoperfectthemanagementofthelawfirm,improvethemanagementoflawyerresources,andpromotethesustainabledevelopmentoftheundertakingofthelawfirm.Thefirstpartoftheessaybringsforwardtheissueoftheencouragingmanagementofthelawyersunderpsychologicalcontract,andintroducesthebackground,aim,significanceandtheresearchingmethods.Inthebackgroundofglobalization,theessayimportstheconceptofpsychologicalcontracttoexploregoodcountermeasuresforsettinguppsychologicalcontractinarightway,bythemeansofquestionnaireandconversation,providingreferencetolawfirmsforthemanagementofthehumanresources.Thesecondpartisasummeryaboutthepsychologicalcontract,introducingtheconceptofpsychologicalcontract,itsdevelopmentandthepresentresearchingsituationinhomeandabroad.Theauthorexplainedthetheoreticalbasis,structure,content,characteristics,effectsandrelativestudyonpsychologicalcontractandmotivationmanagement.Thethirdpartsetsforththemeaningandthenecessityofsettingupthepsychologicalcontractinthemotivationmanagementoflawyers.Itanalysesthecontentofthepsychologicalcontractoflawyersfromthecharacteristicandthevaluetropismofthelawyerhumanresource.Anditalsoanalysesthenecessityofsettingupthepsychologicalcontractinthelawfirmfromtheaspectsoftheorganizationgoal,cohesionandtheorganizationalreform.Psychologicalcontractisalinkbetweenalawyerandhisorherlawfirm,whichisnotonlyapartofthelawyersmentalitybutalsoanimportantfactorinfluencingthemanagementofthelawfirm.Soitcantbeneglectedinthecontentofmanagement.Itisverymeaningfultopayattentiontotheapplicationandestablishmentofpsychologicalcontractinthelawyersmotivationmanagement.Theforthpartinvestigatesthecurrentsituationoflawyersmotivationmanagementunderpsychologicalcontract.Firstly,throughinterviewandquestionnaire,wetrytofindoutthecontentofthepsychologicalcontractbetweenlawfirmsandlawyers,thatis,gettoknowalawyersexpectationtothelawfirmandhisunderstandingabouthisdutyhimself,aswellthelawfirmsexpectationtothelawyerandthelawfirmsunderstandingaboutitsdutyitself.Secondly,surveythecoincidentaldegreeofthepsychologicalcontractbetweenlawyersandtheirlawfirms.Inlawyersview,theperformancesofthelawfirmsarenotverysatisfying,sothatlawyerspsychologicalcontractsaredestroyedtovariousdegrees.Thecontraventionofthepsychologicalcontractaffectsthelawyersenthusiasmnegatively,butthelawyersperformanceisstillconsistentwiththeiraimanddutyonthewhole.Asforthelawfirm,thesituationissimilartothatofthelawyer.Althoughthereissomedifferenceintheirrespectiveconception,theirevaluationofthepsychologicalcontractiscoherentbyandlarge.Finally,theessaysummarizesthefeatureofthepsychologicalcontractbetweenlawyersandlawfirms:firstly,psychologicalcontractisacollectionofthetwosidesknowledgeoftheirexpectationanddutytoeachother;secondly,thecontentofpsychologicalcontractisdynamic;thirdly,thelevelofthedegreeofcorrespondenceofthepsychologicalcontractisrelativelylow.Onthebasisofsummarizingtheresultsofdiagnosis,thefifthpartgivesthemeasuresofsettingupproperpsychologicalcontracttoencourageandadministratethelawyeronthreelevelsincludinglawfirmsmanagement,lawyersselfcontrol,aswellasthesupervisionofjudicialadministrativeorgansandassociationoflawyer.Theinnovationoftheessayisapplyingthetheoryofpsychologicalcontracttothepracticeoflawyersmotivationmanagement.Itanalysesthecontentofthelawyerspsychologicalcontract,andprovidessomeproposalsforlawyersadministration,whichisofpracticalsignificancetotheapplicationofthenonobjectivetheoryofpsychologicalcontractintothemanagementofthehumanresourceoflawyers.Butthediscussionoftheissueisnotdeepenoughandlimitedtotheintroductionandanalysisofthetheory.Becauseofthelackoftime,theauthordidntmanagetocompletethelongitudinalstudyorstudyonitsdynamicdevelopment.Howtoestablishagoodpsychologicalcontractisonlyanideaforthemoment,andtheauthorhaventfo
